CANCUN, México., April 22, 2026: That relaxing vacation at a Mexican beach could end up costing you up to $12,500 for having vape gear on you as you enter México. Although tobacco use across America is heavily regulated among the youth, in 2024 around 1.6 million middle and high school students across the country reported using e-cigarettes. As a tobacco product, vapes can be purchased by anyone over the age of 21. Military members with a valid military ID can purchase vapes at 18. The Surgeon General declared vaping an epidemic in 2019, yet they remain readily available today.

The largest consumers of vaping products are the United States and the United Kingdom. The U.S. is the largest market for vaping products. Over 90% of vaping gear comes from China.

Over 40 countries have banned vape equipment, including México.

Starting this year, México banned the distribution, importation and sales of vaping gear. Any devices, including cartridges, e-liquids, nicotine-free pens are confiscated by Mexican Customs from tourists entering the country. Mexican Customs use high-resolution Xray scanners to detect the lithium batteries used in vaping gear at some of the ports of entry. The fine for carrying vaping gear is usually between $200 and $500 but can go as high as $12,500. Mexican customs confiscate all vape gear they find.

Also banned are the sale and manufacture of vaping gear. Legal stores have closed since the law went into effect in January.

Although personal use of vapes is not illegal, it is prohibited in most indoor and outdoor venues, including Mexican beaches.

Texas does not have laws prohibiting vaping in public spaces. It regulates the sale of vaping equipment much like it regulates tobacco products. Across America, vaping laws vary, however the minimum age is 21 years old to buy e-cigarettes. Some states like California, Massachusetts and New York have strict laws banning the sale of flavored vaping products. Texas and other states have banned the sale of vapes manufactured in China, and other disposable vapes.

In El Paso, the 2002 smoking law prohibiting indoor smoking also covers vaping in public. The county prohibits vaping in and around any County-owned facility. El Paso treats youth arrests for carrying THC vaping products as a felony while schools prohibit vapes within 300 feet of any school.

Three states, Alabama, Georgia and Idaho have the least restrictive vaping laws in the country today. Alabama’s and Idaho’s laws prohibiting indoor smoking does not restrict vaping, while Georgia’s laws do not define vaping, effectively allowing it across the state with few restrictions.

Australia is considered to have the most stringent anti-vaping law, with India, Qatar, Thailand, Singapore and México on the list of countries that highly regulate vaping.
