Andrew Cantu received a 10-year sentence after being convicted of injury to a child with intent to cause bodily injury, a third-degree felony for which he was given the maximum punishment.

Cantu had been charged with capital murder, but that charge was downgraded. 

Simon was walking home from Brewer Academy on April 16, 2025, when police say he was attacked by a group of teens at the intersection of South Elmendorf and Merida streets, two blocks from campus.

First responders found Simon with a gunshot wound. He was pronounced dead at a hospital.

Police also arrested two juveniles, ages 14 and 16. The younger suspects recently had their capital murder charges reduced to assault causing bodily injury.

Another suspect, 20-year-old Caesar Tijerina, died in San Antonio after he had shot himself in Laredo.

Police identified the suspects by examining security camera footage, which showed the moments before and after the shooting. 

In the video, several of the suspects are seen punching and kicking Simon. One of the suspects is seen in the video pulling out a handgun and shooting Simon in the abdomen while he is on the ground. The suspects then left the scene.
