One of Houston’s most well-known billboard lawyers admitted to perjury on Monday, the most recent step in a long and winding suit between infamous Houston trial attorneys Anthony Pusch and Chi-Hung David Nguyen. On Monday, the two sides gathered in Harris County District Court to hear the merits of newly surfaced allegations that Nguyen lied in court.
Nguyen took the stand Monday in a marathon hearing, clad in a dark suit. There, legs crossed, Nguyen sat as Pusch’s attorney, Rodney Drinnon, grilled him. At issue were questions about how, exactly, Nguyen was able to finance the purchase of property along the Gulf Freeway that he allegedly intended to use as a competing legal firm after leaving Pusch & Nguyen, now known as Pusch & Wynne.

Earlier in the day, Nguyen admitted to providing false testimony regarding how the property was purchased. He previously said he got the money from an aunt and uncle. But according to text messages obtained from a firm computer and entered into the record last month, some of the money for that new Gulf Freeway office purchase came in the form of a loan to Nguyen and his brother John by Chassity Murray, a former Pusch & Nguyen client.
Nguyen on Monday testified that he used $2 million in the form of a loan, $450,000 of his own money and $75,000 from his aunt and uncle to purchase a property across the street from the Pusch & Nguyen, contradicting previous testimony. Judge Christine Weems said she felt “duty bound” to warn Nguyen that he had admitted to a crime and that he has the right to plead the fifth.
Weems advised Nguyen to speak with his attorneys privately several times.

Who was acting as what, and when?
The texts show both Nguyen brothers texting with Murray and counseling her to set up an LLC to loan them the money. Drinnon argued that in soliciting Murray for money, Nguyen broke ethics rules governing business transactions with lawyers.

“So you were acting as her attorney to form the LLC, correct?” Drinnon asked Nguyen.
“Truthfully, I don’t know whether or not I was,” Nguyen responded.
Nguyen eventually conceded that he had, in fact, worked to conceal his business relationship and transaction with Murray from his then-business partner, Pusch, going as far as opening a new bank account to keep the loan away from Pusch.

By helping a former client form an LLC that was then used to loan him money, Pusch’s lawyers argued Nguyen may also have violated the Texas Disciplinary Rules of Professional Conduct. That code governs how lawyers licensed in the state of Texas may interact with clients, among other rules. Chapter 1.08 forbids lawyers from making business transactions with clients without disclosing the terms of the deal in writing or allowing a third party attorney to look over the deal. Drinnon gave Nguyen a copy of the rule after Nguyen said he had never heard of it. Nguyen read it and changed his tune.
“I’ve never read the full rule, but I, I’m aware of the rule,” Nguyen admitted.
For his part, Nguyen has claimed that Pusch himself committed perjury, alleging that Pusch previously said he was aware of the Gulf Freeway property purchase, only to now claim he wasn’t. But as Pusch’s team argued, Nguyen’s false testimony was a smoking gun that could make the rest of the hearing moot.
“He’s already admitted to the perjury,” Weems told Drinnon.

“If he’s admitted to the perjury, then why are we still going?” Drinnon shot back.
Attorneys for both sides reconvened on Tuesday to continue the hearing.
