EL PASO, Texas (KFOX14/CBS4) — One of the sons of a family accused of shooting and killing a man during a road rage incident in El Paso’s Upper Valley back in 2023 was found not guilty.
According to the El Paso County District Attorney’s Office, on Wednesday, a jury found Jose Alberto Orozco not guilty of the murder of 32-year-old Marcos Fino Jr., after he and his father, Raul Alberto Orozco, and his brother, Cristian Bradley Orozco, got into an altercation with Fino Jr. at the 5900 block of Doniphan Drive over a mailbox on June 6, 2023.

The cases against the father, Raul Alberto, and the brother, Cristian Bradley– both charged with murder– remain pending.
According to court records, the jury trial for Raul Alberto is scheduled for August 7, while Cristian Bradley’s is set for September 18.

As was reported back in 2023, according to police documents, investigators learned that the deadly incident started after Fino Jr., driving a Chrysler 300, reportedly drove past the family’s home, along Montoya Road, near Oleaster Drive, several times.
Then, Raul, believing that the Chrysler 300 might have been the same car that had crashed into his mailbox, allegedly got into his truck and followed the Chrysler to take down the license plate number.
According to police documents, as Raul followed the car, he allegedly called his sons, Jose and Cristian, to let them know where he was.
Then, investigators allege this is what happened:

According to police documents, Jose told investigators that while he was wrestling Fino Jr., Fino Jr. reached for his gun, which– he reportedly admitted to investigators– was tucked in his waistband, locked and loaded as he felt he needed to be ready.
Jose then reportedly described that as he wrestled with Fino Jr. for control of the gun, the gun fired, hitting Fino Jr.

The Orozcos reportedly fled home after the shooting and then later called the police.
Meanwhile, people at the site of the deadly shooting flagged officers.
Fino Jr. was rushed to the hospital, where he was later pronounced dead.
Viewers sent video of the aftermath of the shooting, where you can see people scrambling to drive Fino Jr. to the hospital.

The deadly incident shocked the community, with some neighbors telling KFOX14/CBS4 that the Orozcos are “good people.”
“They are decent people, good people, hardworking, honest. Cristian is a gentle soul. I’m just at a loss for words, and I really can’t believe this happened,” one neighbor said.
The neighbor also described a little about who they are, saying that Raul is a mechanic who taught his two sons the trade, adding that they have visited the family to fix their car.
