A Texas man has dropped his federal lawsuit against a California doctor who allegedly supplied the abortion-inducing pills his partner used to end her pregnancy.

Jerry Rodriguez didn’t give his reasons for ending the wrongful death suit in Tuesday’s notice of dismissal to the US District Court for the Southern District of Texas but he specified that it was “without prejudice,” meaning he could refile his claims. The filing came before the court ruled on Rodriguez’s June 8 request to amend his complaint for the second time.
