LUBBOCK, Texas (KCBD) – A Lubbock man was arrested on a murder charge after a shooting early Saturday that left another man dead, according to an affidavit.
Police were called just before 2 a.m. to a report of shots fired in the 2900 block of E. Auburn St. Officers found 37-year-old Stephon Jones lying in the street with what appeared to be a gunshot wound. Jones was pronounced dead at the scene.
According to the affidavit, 65-year-old Robert Kinney was the person who fired the gun. It said Kinney stayed at the scene and was placed in the back of a patrol car in handcuffs while officers secured the scene and investigators with the Lubbock Metropolitan Special Crimes Unit and the police department’s forensic unit arrived.
Investigators interviewed multiple witnesses and one witness said they saw Kinney shoot Jones. The investigation also found Kinney fired shots while inside his fenced yard and in the street in front of the home.
In a sworn statement, Kinney told detectives he had been asleep when his wife woke him after a family member called to say unknown people were bringing his son home.
Kinney said he went outside and saw multiple cars arrive, then returned inside to retrieve a gun and came back out. He told investigators he fired a warning shot into the air while in his yard, then approached a car parked along the curb and saw his son in the backseat.
As he tried to wake his son, Jones approached and struck him in the face, Kinney told investigators, according to the affidavit. Kinney said that as he was being hit, the gun in his right hand discharged and he acknowledged squeezing the trigger. The affidavit said Kinney did not report seeing any weapon other than the gun he had.
After the shooting, Kinney told investigators he went inside, told his wife to call 911, placed the gun on a table and waited for officers.
The affidavit said there was probable cause to believe Kinney “intentionally or knowingly discharged a firearm which resulted in the death” of Jones.
Kinney has been arrested and is now facing a murder charge. He is held in the Lubbock County Detention Center on a $250,000 bond.
