LUBBOCK, Texas (KCBD) – On Tuesday, a Lubbock County grand jury indicted 31-year-old Westley Russell on charges of aggravated assault with a deadly weapon and aggravated assault against a public servant.
Lubbock Police Chief Seth Herman previously said officers were called a little after 12 p.m. May 10 for a civil standby at a home in the 3400 block of 38th St. after a person asked for police to be present while moving belongings following a breakup with Russell.
Herman said the responding officer met the caller and the caller’s brother at a business before going to the residence at 1:48 p.m., where the officer, the caller and the brother legally entered the home and Russell became “extremely agitated.”
Herman said Russell grabbed a handgun and pointed it at the brother and then the officer. The officer fired, striking Russell “at least twice,” Herman said, and then began providing aid, but Russell was not cooperating and refused medical help.
Russell was taken to UMC for treatment. After he was released from the hospital, Herman said Russell was taken to the Lubbock County Detention Center and initially charged with aggravated assault.
The officer involved was placed on administrative leave while an internal investigation continued under Lubbock police policy, and the Lubbock Metropolitan Crimes Unit was also conducting a standard investigation, Herman said.
