LUBBOCK, Texas (KCBD) – The Texas Tech University System is seeking the Texas Attorney General’s opinion to determine what contract details can be released following the university’s announcement of the renaming of its football stadium.
On July 17, Texas Tech Athletics announced a 15-year naming rights agreement with Galaxy, rebranding the university’s stadium as Galaxy Stadium.
KCBD submitted an open records request on the same day of the announcement, July 17. KCBD received Texas Tech’s response on July 31. The Texas Public Information Act states a governmental body must either provide records requested, respond with a reasonable timeline to produce the records, or notify the requestor it is seeking an Attorney General’s opinion on release of the records, within 10 days.
Texas Tech is a public entity. Galaxy is a private company. Texas Tech’s Office of General Counsel’s letter states:
“The requested document(s) may contain proprietary information belonging to a third party. Pursuant to Tex. Gov. Code § 552.305, TTUS may rely on the third party to establish that the requested information should be withheld under applicable exceptions intended to protect the third party’s interests.
TTUS will not release the requested documents until the Attorney General makes a decision regarding the public disclosure of the document(s). Please note, TTUS only posts a summary of the contract details pursuant to Texas Government Code section 2261.253, the entire contract is not publicly posted due to proprietary concerns. The required third-party notice is attached as Exhibit “C”. Since TTUS has not taken any position with regard to the third-party claims, we have enclosed an unmarked copy of the requested document as Exhibit “D” and will rely on the third party to mark and explain the applicability of any exceptions to disclosure of the requested document.”
Once the Attorney General makes a decision, Texas Tech will then provide what contract details the AG determines can be released to the public.
