A panel of federal appeals court judges indicated they don’t think a lower court was right to dismiss a tax lawsuit from a group of Texas homeowners who say Austin’s 2019 annexation of their homes was improper.
Judge Kurt D. Engelhardt of the US Court of Appeals for the Fifth Circuit said that, while the city is now taxing these homes, it may not be providing them with municipal services like water and wastewater.
“Your opponent is saying they’re not getting city services, they’re paying for something they’re not getting,” Engelhardt told Austin’s attorney in Monday’s argument.
