An El Paso uncle was trying to help his niece when he was repeatedly shot and killed by her husband at a Cielo Vista-area apartment complex, court documents stated.

Miguel Angel Garcia, 36, died after being shot multiple times late Sunday morning, Nov. 2, at La Estancia Apartments, 7900 Viscount Blvd.

“Miguel left behind his mother, sister, the mother of his children, his children, and other loved ones whom are all hurting from his sudden death. Miguel was shot and killed protecting someone he loved, a family member,” stated a GoFundMe page created to help the family with funeral expenses.

El Paso police arrested Jaeveyin Antonio Porter, 21, on a murder charge soon after the shooting. He remained jailed on a $250,000 bond at the El Paso County Jail Downtown as of Thursday, Nov. 6, a jail log showed.

When interviewed at El Paso police headquarters, Porter told homicide detectives that he and his wife had been arguing since Halloween, Oct. 31, because Porter was being accused of infidelity, according to a complaint affidavit filed by a detective obtained by the El Paso Times. The wife, who is considered a witness, is not named in the document.

Husband and wife both told investigators that the argument about infidelity continued into the Sunday morning of Nov. 2, the affidavit stated. El Paso County records show the couple was married in January.

Porter’s wife told detectives that she left the couple’s apartment to meet her family at church. As she was driving to church, she and Porter were still communicating via cell phone and she decided to return to the apartment and on the way back she picked up her uncle, Garcia, because she wanted his help in asking Porter to leave the apartment, the affidavit stated.

Porter told detectives that he was at home when his wife told him via cell phone that she wanted him out of the apartment and that she was on her way back with her uncle, the affidavit stated.

Uncle breaks down door to apartment

When the wife returned, she tried to use the front door key, but was unable to get inside because all the locks on the door were closed, the affidavit stated. She said she called Porter on his cell phone in a “calm manner” telling him to open the door and that she was outside with her uncle. They waited at the door four to five minutes.

Porter told detectives that he told his wife that he wasn’t going to open the door unless her uncle left, the affidavit stated.

The woman then asked Garcia to force open the door since she was also on the lease. Garcia rammed the door with his shoulder and body weight, hitting it twice until it flung open.

Porter told police he was inside his home when he heard the door being hit several times and he grabbed his cell phone to start recording. He said that he didn’t call 911 and then stopped the interview with detectives, the affidavit stated.

Fatal shooting at La Estancia Apartments

A witness reported seeing Garcia at the door yelling, telling someone to open the door in Spanish before he broke down the door with his shoulder. About eight gunshots were heard after the door was forced open, the affidavit stated. The shooting occurred about 11:49 a.m., police stated.

Once the door flew open, the wife told detectives that she saw Porter coming down the inside stairs of the apartment townhome as he started shooting toward her uncle. About four gunshots rang out. Porter allegedly exited the apartment and continued shooting at Garcia, the affidavit stated.

The affidavit mentions that two other witnesses reported hearing the woman asking Porter why he shot Garcia with Porter responding, “I don’t give a (expletive)” and “I don’t (expletive) care.”

Police and paramedics responding to the shooting arrived to find Garcia dead with multiple gunshot wounds on the front walkway of the second floor of the apartment building, the affidavit stated.

The affidavit noted that Porter was allegedly seen leaving with the gun in hand. Shortly after the shooting, an officer found and detained Porter next to the apartment complex on Sunmount Drive. Porter allegedly told the officer that the gun was inside the center console of his car in the parking lot.
