Court documents show the gun was fired while four men were sitting inside an SUV outside the Harbour Landing Apartments, leaving one man shot in the back.

CORPUS CHRISTI, Texas — A Robstown man was arrested after another man was shot in the back while four men sat inside a vehicle outside a Corpus Christi apartment complex, according to court documents.

Armando Velasquez, 23, was charged with aggravated assault with a deadly weapon after the early morning shooting at the Harbour Landing Apartments in the 8000 block of South Padre Island Drive.

According to the probable cause affidavit, Corpus Christi police responded to the apartments at about 2:42 a.m. Aug. 3 after receiving a report that a man had been shot.

When officers arrived, they found the victim sitting outside a gray GMC Terrain with the front passenger door open. Court documents show the victim had a gunshot wound to his lower right back. Police applied pressure to the wound before medics took him to Bay Area Hospital.

Investigators interviewed the three other men who were at the scene. Court documents show they had planned to get food before the shooting happened.

According to the affidavit, one of the men had recently bought the handgun from Velasquez and had the firearm locked inside a red gun case in the back seat of the SUV. Court documents show Velasquez asked to see the gun, unlocked the case and removed the firearm.

The affidavit states Velasquez pulled the slide back to clear the weapon but never checked whether the magazine was loaded or whether a round remained in the chamber. Court documents show he believed the gun was unloaded because he did not hear what he expected to be the sound of an empty firearm.

According to investigators, Velasquez was holding the gun with the barrel pointed toward the back seat when he pulled the trigger. Instead of hearing the expected click, the gun fired, striking the victim in the back.

The affidavit states that everyone immediately got out of the vehicle, and another man called 911.

Police seized the handgun as evidence before arresting Velasquez. He was booked into the Nueces County Jail on a charge of aggravated assault with a deadly weapon.

The case remains under investigation.
