EL PASO, Texas (KFOX14/CBS4) — A man arrested and accused of driving drunk and causing a deadly crash in Far East El Paso was arrested again a month after being released from jail on bond and failing to follow alcohol testing conditions.

Jail records show Gerard Anthony Nelson Jr. was booked into the El Paso County Downtown Jail on Tuesday.

KFOX14/CBS4 reached out to the El Paso County District Attorney’s office to learn what had happened, and according to the DA, Nelson Jr. was arrested after he skipped four alcohol breathalyzer tests from July 25 to August 25, failing to follow the conditions of his release.

On Thursday, Nelson Jr. went before a judge who set his bond at $350,000.

Nelson Jr. had been arrested in December 2025 after he allegedly ran a red light on Montana and Desert Meadows Road and crashed into a car, sending the 60-year-old driver, Lucia Villa, flying from the car and to her death and seriously injuring three other people.

Nelson Jr. was booked into the El Paso Jail annex on Dec. 7, 2025, and charged with intoxication manslaughter with a vehicle.

According to jail records, Nelson Jr. remained in jail until he posted bond on July 9.

However, as part of the conditions for his release, Nelson Jr. had to submit to breathalyzer tests using a LifeSafer Portable Alcohol Monitor (PAM).

According to the arrest affidavit obtained by KFOX14/CBS4, when Sheriff’s deputies arrived at the two-vehicle crash, a witness said Nelson was traveling at a high rate of speed toward Desert Meadow when the light turned red.

While Nelson was about four car lengths from the light, police say he drove through the intersection as the Ford Focus entered the intersection, leading Nelson to crash into the front left side of the Ford Foucs.

Police say the impact caused the front left tire of the Ford Focus to break off and embed into Nelson’s vehicle. The engine from the Ford Focus also broke off and struck a utility pole.

Police say the female passenger, Villa, was ejected from the Ford Focus car and was transported to Sierra Providence East, where she later died.

The three remaining passengers were rushed to the hospital with injuries described as life-threatening.

Nelson was also taken to the hospital and dismissed with minor injuries.

According to the affidavit, Nelson claimed he did not have anything to drink, but deputies could smell an odor of an unknown alcoholic beverage on Nelson.

Additionally, police found a broken whiskey bottle on the front passenger seat with the bottle cap still sealed.

Police conducted a field sobriety test on Nelson at the hospital, where he showed 6 of 6 clues of being under the influence according to the horizontal gaze nystagmus test.
