Judge grants restraining order against NCAA in Atwell case

LUBBOCK, Texas (KCBD) – A Lubbock County judge has sided with former Texas Tech guard Donovan Atwell in a lawsuit against the NCAA.

District Judge John Grace issued a temporary restraining order against the NCAA, saying Atwell would suffer irreparable harm if he’s kept off the court this year.

The order blocks the NCAA from using its “new 5 for 5” eligibility rule to stop Atwell from practicing or playing for Texas Tech, or from punishing Texas Tech if the school lets him play.

Grace said Atwell is likely to win on his claims and that he cannot be fully paid back if he loses this season.

Atwell can now join preseason workouts as the case moves forward.

A hearing on a longer-term injunction is set for Sept. 11. Texas Tech’s first game is Oct. 23.
