EL PASO, Texas (KFOX14/CBS4) — In this week’s “Legal Jargon” segment, attorney Daniela Labinoti discussed the legal recourse available to motorists who suffer car damage due to construction materials on the road.
Labinoti explained that construction companies have a duty to ensure their work does not create dangerous conditions for drivers.
“Absolutely, you can,” she said when asked if motorists can sue for such damages. Labinoti recounted cases her firm has handled, including one where misplaced vertical panels led to a fatal accident.
She emphasized that construction companies, unlike government entities, can be sued like any private party.
Motorists can seek compensation for personal injury damages, medical expenses, loss of wages, pain and suffering, and even car damage.
“They need to pay attention, their employees need to pay attention and they cannot cause dangerous condition on the road that harms others,” Labinoti said. The statute of limitations for such claims is two years.
