LUBBOCK, Texas (KCBD) – A man was indicted today by a Lubbock County grand jury for murder after shooting and killing someone he claimed was chasing him on his property.

Court Documents: Man claims he was chased on his property before deadly Lubbock County shooting

According to the Lubbock County Sheriff’s Office, deputies were called to the 6100 block of E. CR 7260 after receiving reports of shots fired on Dec. 8 at 2:38 p.m.

According to court documents, 54-year-old Leslie Harston called and told dispatchers someone he didn’t know was chasing him on his property and that he had shot the person, who was later identified as 53-year-old Alfredo Garza.

Harston admitted to the shooting and secured the firearm in his house. When deputies arrived, they found Garza with multiple gunshot wounds and began life-saving measures. He was taken to UMC with life-threatening injuries where he later died. Harston requested medical treatment and was also taken to UMC.

During the investigation, a pickup truck was found parked on the property with a bullet hole. During the time of the shooting, Harston’s brother was inside the home.

He told investigators he was asleep when he was woken up by an argument between his brother and an unknown man. He then heard gunshots and Harston told him there was a dead body on the property.

Investigators then found drag marks outside and injuries to Garza’s back consistent of being drug along the ground. Harston said he was approached by Garza who was asking to speak with him. He then said Garza called him a derogatory word before chasing him.

Court documents state “after running around the property twice, [Harston] stopped, turned towards the unknown male, and without saying a word to the unknown male shot him multiple times.”

Harston admitted to investigators Garza did not have any weapons nor did he threaten any physical violence. He also stated he then broke Garza’s phone out of frustration and mentioned dragging his body onto his property because he was lying on the fence lines.

Harston is still being held at the Lubbock County Detention Center.
