HOUSTON, Texas (KTRK) — Two teens have been charged with the murder of a Klein Collins High School student the day after Christmas, according to authorities.

Deputies said that charges were filed against one 16-year-old boy on Saturday and against another 16-year-old boy on Monday.

The victim, 18-year-old Michael Spivey, was shot inside his bedroom at the family’s home on Edsall Drive in Spring on Dec. 26.

His mother, Vanessa Garcia, said her son considered the two suspects friends.

“They said they needed help that night to come charge their phones and he let them in. They took advantage of my son’s kindness,” Garcia said.

Garcia said her son was shot in the back of the head and robbed.

While the teens are currently charged with murder as juveniles, Garcia is pressing prosecutors to certify them as adults and upgrade the charges to capital murder.

Since 2022, only about a quarter of murder cases in Harris County have been filed as capital murder.

Data from the Texas Juvenile Justice Department shows that 1 in 13 juvenile offenders are charged with murder. The percentage has been increasing in recent years.

“A juvenile is a child who doesn’t know what they’re doing yet,” Garcia said. “They knew what they were doing. They went there with the intent to do it.”

Garcia said she’d like to see her son’s killer serve life sentences at a minimum.

“These boys who did this to my child only made it harder by going online and making songs about him, making fun of him like if my son was a joke,” she said.

The District Attorney’s Office said it’s unable to comment on the ongoing criminal cases since they’re taking place in the juvenile court system.
