DALLAS — A conservative think tank based in Austin has sued the City of Dallas for allegedly violating a state law that places a limit on local regulations that violate laws set out by the state.
That law, nicknamed the “Death Star” law, is actually called the Texas Regulatory Consistency Act, and the suit suggests that Dallas has committed 83 violations of state regulation.
These alleged violations range from making recycling mandatory to dictating a minimum wage for city contractors to regulations for gas drilling and production.
According to an article in the Dallas Morning News, the think tank, called The Texas Public Policy Foundation, filed the notice on behalf of three residents — Haley Kyles, Tamara Brown and Daniel Rodriguez — who claimed the ordinances had harmed them.
The “Death Star” law itself has been the subject of litigation, with an appeals court in July overturning a lower court ruling that the law was unconstitutional.
