EL PASO, TEXAS (KFOX14/CBS4) — The men accused of fatally shooting Parkland High School student Ramon Vargas in 2020 will not face murder charges, the El Paso District Attorney said on Tuesday.
Vargas, 18, was found on Dec. 13, 2020, on the 10300 block of Dyer Street in Northeast El Paso with fatal injuries after he said he was going shooting with some friends.
Shortly after Vargas was found, two men, Dalton Delgadillo, then 21, and Angel Duran, then 17, were arrested on suspicion of murder in Vargas’ death.
While the cases against both men remained at a standstill for many years, El Paso District Attorney James Montoya confirmed in a statement to KFOX14/CBS4 on Tuesday that Duran and Delgadillo will not face murder charges in connection with the fatal shooting, as there was not enough evidence to prosecute.
“While Mr. Delgadillo was found to be in possession of the firearm used to kill Ramon Vargas, the investigation was unable to conclusively determine who actually shot Mr. Vargas or the motive, if any, for doing so. As a result, at this time, there is insufficient evidence to bring or prove any additional charges,” Montoya said.
According to court records, Delgadillo pleaded guilty on Thursday, Oct. 23, to one count of deadly conduct by discharging a firearm and was sentenced to three years in prison. In a separate but related case, he also pleaded guilty on Tuesday, Oct. 28, to one count of unlawful carrying of a weapon, with a sentence of eight days in the county jail.
The arrest affidavit states the firearm recovered in the arrest of Delgadillo, “was the same caliber as the empty bullet casings found near” Vargas.
Meanwhile, Duran has not faced any charges in the case and will likely not face any, as the district attorney does not have enough evidence.
What Happened Five Years Ago
On December 13, 2020, Vargas was found by his girlfriend after she tracked his cellphone through an application that she shared with him.
Vargas had told his girlfriend that he was going shooting with some friends.
According to the initial arrest affidavit for Duran, Duran claimed Delgadillo shot Vargas and that Delgadillo threatened him not to talk about the shooting.
Duran also claimed Delgadillo assaulted him outside his residence following the shooting. Duran’s mother also told officers about the assault, according to the affidavit.
The alleged assault happened in front of Duran’s house as the suspect was driving a silver BMW.
Officers who responded and investigated that assault arrested Delgadillo on a charge of unlawful carrying of a weapon when he was found to have a Ruger 10mm semiautomatic handgun, the complaint affidavit states. This resulted in the charge that Delgadillo pleaded guilty to last week.
Meanwhile, according to the initial affidavit for Delgadillo, he claimed it was Duran who shot Vargas after he was taken into custody.
Delgadillo was also found in possession of a handgun matching empty bullet casings found near Vargas’s body. This resulted in the charge of deadly conduct by discharging a firearm on Oct. 23.
Both men claim to have been intoxicated when the shooting occurred and neither provided details on what may have led to the shooting, according to police.
According to the El Paso Times, Duran was arrested on Dec. 17, 2020, in connection with Vargas’ death. He was released from jail on Dec. 24, 2020, jail records show.
Meanwhile, Delgadillo was arrested on Dec. 15, 2020, on a murder charge. Delgadillo remained jailed until Sept. 26, 2022, after he posted a $250,000 bond, jail records show. He was given 652 days of time served credit as part of the plea agreement on the deadly conduct by discharging a firearm charge, court records show.
