COLORADO SPRINGS, Colo. (KKTV) – Tuesday afternoon, officials with El Paso County announced that Buc-ee’s had filed an appeal in regards to its proposed development in the area.
In late June, the Planning and Community Development Director was unable to determine whether Buc-ee’s should be classified as a ‘Convenience Store’ under the county’s Land Development Code.
The county said the director was not able to decide if the proposed use is similar enough to the allowed uses under the C-1 zoning district.
On Tuesday, Buc-ee’s EPCO, LLC filed the appeal regarding the Planning and Community Development Director’s decision.
The county said this appeal will be heard during a public meeting. The date of that meeting has not yet been determined.
The county said the Board of County Commissioners will consider the appeal and will make the ultimate decision on the meaning and application of the C-1 zoning, including its type, nature and uses.
The county confirmed that the Board of County Commissioners will only be deciding if the proposed Buc-ee’s use is allowed within C-1 zoning or similar enough to be allowed.
The board is not deciding whether to approve or deny the development itself.
In late April, Buc-ee’s EPCO, LLC bought land near I-25 and County Line Road for more than $10 million, according to records from El Paso County. The land is in the same area that Buc-ee’s had been eyeing for more than a year, following an annexation effort and a property line change.
