Texas’ new Secretary of the State Robert S. Howden will continue to defend a lawsuit the Republican Party of Texas brought against his predecessor to close primary elections to voters who aren’t registered with the party.

Howden however said his office “would gladly implement” the change if approved by the state Legislature.

“The Secretary continues to believe that the Legislature is the proper forum for adopting any closed primary system and thoughtfully crafting the detailed scheme that would govern it,” his lawyers wrote in a filing Monday is the US District Court for the Northern District of Texas.
