LUBBOCK, Texas (KCBD) – The punishment phase in the trial of Victor Yanez is underway after he was found guilty of murder.
A jury convicted Yanez for the shooting death of 38-year-old Joshua Rios.
The jury convicted Yanez Thursday after two hours of deliberation. Yanez was retried after Judge William Eichman granted the defense’s motion for a mistrial.
Police say Yanez shot Rios outside of a bar near 2nd and Clovis in April of last year.
Prosecutors say Yanez is a gang member who was involved in other crimes, like prostitution.
The defense says these are pop culture influences, not the actions of a gang member.
