Republican state lawmakers have been working hard to try and end the blue-city practice of letting repeat violent offenders stay out of prison.

But there has been yet another fail, from the Harris County Jail.

According to reports, the man charged with capital murder in the shooting death of a Good Samaritan on Wednesday was previously charged with four felonies while serving time for an aggravated assault.

30-year old Otis Parks,is accused of shooting and killing 58-year-old John Donat while he was feeding the homeless outside a hotel on Highway 6 in west Houston.

Parks was out of jail because authorities opted not to have spend extra time after he was charged with 4 other felonies, that he committed while in the Harris County Jail awaiting his transfer to prison.

The bottom line is, he should not have been released.
