The suspect in a Plano hammer attack was an illegal alien, released under former President Joe Biden’s administration.
Sergio Noe de Nova Duarte, 17, was charged with aggravated kidnapping for allegedly attacking a woman with a hammer in Plano’s Bob Woodruff Park on November 13, as The Dallas Express reported. Now, the Department of Homeland Security announced he was an illegal alien from Mexico, released under Biden in 2024.
“This criminal illegal alien should have never been loose in our communities to attack this woman jogging in a park with a hammer,” said DHS Assistant Secretary Tricia McLaughlin in a November 17 press release. “ICE lodged an arrest detainer to ensure this criminal illegal alien is NEVER able to prey on innocent women in our country again.”
Duarte was held in the Collin County Jail on the kidnapping charge and an immigration detainer on November 14, as The Dallas Express reported at the time.
The night of the assault, Plano police responded near 2300 Shiloh Road around 5 p.m., as The Dallas Express reported.
“The female victim was jogging in Bob Woodruff Park when she was attacked by an unknown male who used a hammer to strike the victim,” the department posted.
The suspect – now identified as Duarte – fled the scene. Meanwhile, Plano Fire-Rescue brought the woman to a local hospital. That night, Plano police announced they had captured Duarte.
He allegedly tried to duct tape the woman during the attack, but she fought him off, according to Fox News National Correspondent Brooke Taylor.
Duarte first entered America in 2016 on a B2 tourist visa, which required him to leave the country in September that year, according to the release. But he reportedly had a “lengthy rap sheet,” including 2024 arrests for burglary and larceny.
After these arrests, ICE apprehended Duarte – but the Biden administration reportedly released him back into the country, with a notice to appear before an immigration judge in 2026.
