An El Paso man facing a murder charge in a vicious stabbing at a DK gas station allegedly assaulted a jail officer while awaiting trial.

Manuel Ivan Gutierrez, 30, faces a new charge of assault of a public servant for allegedly hitting an officer in the face with a sock containing two bars of soap while food was being served, a magistrate judge said at a bond hearing.

The jail assault occurred on Friday, Dec. 19. Gutierrez is incarcerated at the El Paso County Jail in Downtown, according to a jail log.

Gutierrez has been jailed since his arrest last month after he allegedly killed Francisco Gomez, 44, by stabbing him 20 to 25 times during an altercation on the morning of Nov. 11 at the DK convenience store, 5600 Alameda Ave. near Fox Plaza.

Gutierrez, wearing an orange-and-white jail jumpsuit, appeared at a teleconference bond hearing on the assault charge before Magistrate Judge Antonio Aun on Dec. 22.

During questioning by a public defense attorney Joshua Keton, Gutierrez commented that he had a mental health diagnosis and had not taken his medication on the day of the hearing.

Aun set the bond on the assault case at $10,000. Gutierrez remains held on a $400,000 bond on the murder charge.
