{"id":118286,"date":"2026-01-10T18:22:08","date_gmt":"2026-01-10T18:22:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/118286\/"},"modified":"2026-01-10T18:22:08","modified_gmt":"2026-01-10T18:22:08","slug":"samsung-restraining-order-vacated-by-texas-court","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/118286\/","title":{"rendered":"Samsung restraining order vacated by Texas court"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-tx\/wp-content\/uploads\/2026\/01\/959199540a162f1f49d670f08b4cbd63.jpg\" alt=\"\" data-v-7d0efd03=\"\"\/> article    <\/p>\n<p data-v-6c8e215c=\"\">One day after issuing a <a href=\"https:\/\/www.fox7austin.com\/news\/texas-restraining-order-samsung\" target=\"_blank\" rel=\"noopener nofollow\">temporary restraining order<\/a> against tech giant Samsung, a Texas court set that order aside, rendering it null.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">The initial order was put in place after Texas AG Ken Paxton accused Samsung, along with four other television manufacturers, of spying on state residents.\u00a0<\/p>\n<p> Samsung restraining order vacated  <\/p>\n<p original-article-post=\"\" origination_station=\"KTBC\" data-v-ec26887a=\"\" data-v-6c8e215c=\"\">The latest:<\/p>\n<p data-v-6c8e215c=\"\">A Collin County district court vacated the order at 10:10 a.m. Tuesday, Jan. 6, one day after the TRO was put in place.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">The order vacating the TRO says the court found the original order should be set aside, giving it no force or effect whatsoever.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">Samsung reached out to FOX Local to add that their TRO hearing happened Friday, Jan. 9, and the TRO application was denied.<\/p>\n<p data-v-6c8e215c=\"\">Original reporting on the TRO against Samsung came after Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-secures-major-win-stopping-samsung-using-its-smart-tvs-illegally-spy\" target=\"_blank\" rel=\"noopener nofollow\">put out a press release<\/a> on Tuesday announcing the order had been made. It should be noted that Paxton did not inform the public that the order was vacated that day.\u00a0<\/p>\n<p original-article-post=\"\" origination_station=\"KTBC\" data-v-ec26887a=\"\" data-v-6c8e215c=\"\">What we don&#8217;t know:<\/p>\n<p data-v-6c8e215c=\"\">No reason was given for vacating the TRO.\u00a0<\/p>\n<p> Texas gets restraining order against Samsung <\/p>\n<p original-article-post=\"\" origination_station=\"KTBC\" data-v-ec26887a=\"\" data-v-6c8e215c=\"\">The backstory:<\/p>\n<p data-v-6c8e215c=\"\">The original TRO, which has since been nullified, said the court found that Samsung does collect and use user data with Automated Content Recognition technology, thereby violating the Texas Business &amp; Commerce Code.<\/p>\n<p data-v-6c8e215c=\"\">Samsung is therefore prohibited from continuing to collect and use or share ACR data until further court proceedings take place.\u00a0<\/p>\n<p>  Paxton sues TV makers <\/p>\n<p data-v-6c8e215c=\"\"><a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-paxton-sues-five-major-tv-companies-including-some-ties-ccp-spying-texans\" target=\"_blank\" rel=\"noopener nofollow\">Paxton is concerned<\/a> over Automated Content Recognition technology, which recognizes the sights and sounds on some TV sets for content optimization.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">The attorney general referred to ACR as &#8220;an uninvited, invisible digital invader,&#8221; saying it sends your data back to the company without your consent.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">Paxton sued Sony, Samsung, LG, Hisense and TCL Technology Group Corporation (&#8220;TCL&#8221;) over the tech. The last two are based in China, prompting Paxton&#8217;s national privacy fears.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">Hisense was <a href=\"https:\/\/www.fox7austin.com\/news\/texas-restraining-order-hisense\" target=\"_blank\" rel=\"noopener nofollow\">also hit with a TRO<\/a> shortly after the lawsuits were filed.\u00a0<\/p>\n<p>  What is ACR technology? <\/p>\n<p original-article-post=\"\" origination_station=\"KTBC\" data-v-ec26887a=\"\" data-v-6c8e215c=\"\">Dig deeper:<\/p>\n<p data-v-6c8e215c=\"\">In the most basic terms, ACR technology sees and hears what you&#8217;re watching so it can get an idea of your taste in content, and then recommend things you might like based on what you&#8217;ve seen.\u00a0<\/p>\n<p data-v-6c8e215c=\"\">This technology is typically opt-in, meaning you have to agree to let your TV use it.
