They are basically saying Gonzales didn’t do a whole lot in those crucial three minutes, which allowed the shooter to sneak inside the building. The defense claims that Gonzales was doing things like assessing the situation, calling for backup, etc.

11:40 a.m. The defense attempts to make the point that interacting with with Melody Flores caused delay and confusion of Gonzales’ reaction and Gonzales was trying to figure out what was going on. The defense passes the witness.

11:35 a.m. The prosecution finishes cross examination and passes the witness. Defense resumes questioning.

11:30 a.m. The prosecution asks the witness if he would have reacted as slowly as Gonzales.

Prosecution: You would have stood there for three minutes?

Cantu: Me? I was not there, sir.

Prosecution: You would have stood there for three minutes?

Cantu: I was not there experiencing everything that was being experienced….I would have absorbed information differently.

Cantu: I would like to think so

11:25 a.m. The prosecution is making the point that shots were fired inside the school building while Adrian Gonzales was outside the building. They claim Gonzales was standing outside for long time, which lost crucial seconds to stop the killer.

11:15 a.m. The prosecution is now questioning Cantu. They are making the point that if you hear gunfire, you have to run toward the gunfire and address it, according to standard training.

11:12 a.m. Cantu provides analysis that the west door of the fourth grade building that the shooter went into was unlocked. The south door of the fourth grade building that Adrian Gonzales first goes into was also unlocked. The doors to classrooms in the fourth grade building also appear to have been unlocked.

11:03 a.m. “Different people will handle it a different way.” Cantu says not everyone will react the same way to every situation.

10:58 a.m. After taking a few minutes to process the information he received from Flores, Gonzales got on the radio and broadcast accurate and urgent information, Cantu says on the stand.

10:52 a.m. The first witness that Gonzales encountered when he arrived on scene was Melody Flores. Gonzales was talking to her around the time the gunman snuck into the west side of the fourth grade building. Flores was frantic at the time, and Cantu said some of her accounts were inconsistent, which is a natural for someone going through a traumatic situation such at that.

10:50 a.m. The defense is going point by point with the witness as to the first three minutes in question that Adrian Gonzales arrived on scene. Cantu says that when shots are fired, it is difficult to locate where shots are coming from. This contradicts what a state’s witness had previously said in testimony.

10:40 a.m. The witness agrees that if an officer saw a person running with a gun, then it would be dangerous to run after that person. He said, if it had been him, he would have hung back.

10:35 a.m. Cantu explains how a law enforcement officer might respond to each of the key pieces of information that Adrian Gonzales received in the initial moments he got to the scene.

10 26 a.m. The witness agrees that his skills learned over time with SWAT are “perishable” skills, meaning that ‘if you don’t use them, you lose them.” He also says “auditory exclusion” and perception distortion that can affect how people respond to stressful events.

10:23 a.m. The defense makes the point that Adrian Gonzales did not receive the type of SWAT training that the fully certified SWAT team members received, which takes years and evolves over time.

10:15 a.m. The defense asks the witness about SWAT working as a team. The witness agrees that they are a team and operate as such. They would also respond with rifle-rated vests.

10:10 a.m. The witness is dismissed after the prosecution declines to cross-examine. The defense calls witness Guillermo Cantu, a retired SAPD sergeant. He has SWAT team experience as well.

10:07 a.m. The defense shows low-quality video from the funeral home that shows the shooter ducking between cars and trying to stay out of view. The defense is making the point that the shooter was out of view from where Adrian Gonzales was when he initially responded, due to the gunman hiding and ducking down.

Below is a screengrab from that low-quality surveillance video.

10:05 a.m. The witness saw the gunman slowly make his way toward the school building. She and the other funeral home employees went outside to potentially help with the accident. The driver/gunman started shooting at them and they ran back into the funeral home.

9:55 a.m. The defense begins its case by calling its first witness, Claudia Rodriguez, who was working at the funeral home across the street from Robb Elementary.

9:40 a.m. Goss asks the judge for a motion of directed verdict, i.e. poor presentation of evidence which makes it hard for the other party to present their case. The motion is overruled and court goes into a short recess.

9:38 a.m. Goss additionally argues to the judge that the prosecution has not provided evidence on each of the indictments against Gonzales. He also says one of the key witnesses in the investigation was not identified, which affects their ability to argue their case.

9:30 a.m. Defense attorney Jason Goss tells the judge (outside of the presence of the jury) that the state withheld information about the timeline. He says witness Hill changed his information. The key issue here is that Hill’s report says some of the things said over radio early on were listed as “unknown,” not Gonzales, but Hill later said it was, in fact, Gonzales. The defense asks for the Hill’s testimony to be thrown out. The judge wants to move on and said the defense should hold on to that line of argument for a potential appeal.

9:27 a.m. The witness is excused and the state rests its case.

9:25 a.m. The witness admits that some of the radio traffic audio from Gonzales is not in Hill’s critical timeline. The witness said it was information learned later after the timeline was put together. The defense is suggesting that the critical timeline is incomplete or inaccurate and that the witness is not credible.

9:24 a.m. The prosecution objects to the defense’s line of questioning on the accuracy of the timeline and tension erupts between the defense and prosecution.

Prosecution: “You are misleading the jury.”

Defense: “How dare you say that?”

Judge: “Objections made to the bench only.’

9:22 a.m. The defense says two of the pieces of information from Hill’s redirect were not accurate to his timeline. LaHood asks if the witness “talked to the government this weekend.” Hill said he did once.

9:18 a.m. The prosecution passes the witness and defense is cross-examining him on the redirect testimony.

9:10 a.m. The prosecution is attempting to show, based on the Uvalde PD officers testimony and body cam, that Gonzales might have been able to see the gunman run along the wall of the school and enter the building.

9:08 a.m. Hill clarifies that Sgt. Coranado, Ofc. Saucedo and Ofc. Mendoza arrived around the time the gunman had dropped a bag at the west wall and fired six shots outside the building, before entering the school. It is unclear if those officers had the ability to see the bag or witness the shooter entering the building.

9:05 a.m. Hill testifies that once shots are fired in an active shooter situation, training dictates that officers need to move toward the shooter “with cover.”

9:01 a.m. The cross examination is over and the witness was passed bck to the prosecution. The prosecutor asked him to clarify his role in the investigation. Hill explained that his investigation included more than 300 pieces of physical evidence, more than 700 audio and video recordings and more than 7,000 photographs.

8:56 a.m. The issue comes up of “backdrop” when you are in a school, gymnasium or theater situation which makes it difficult to determine what is behind the shooter.

8:52 a.m. LaHood asks if the witness reviewed, before testifying, some of these interviews, including the female witness and the three Uvalde PD officers who initially responded. LaHood claims those interviews appear to conflict with his timeline. Hill said he reviewed the parts of the interviews pertaining to his role in the investigation.

LaHood: “So your timeline is not accurate?”

Hill: “My timeline is accurate.”

8:50 a.m. Defense attorney Nico LaHood is pointing out that Hill interviewed a witness who saw that initial moments the shooting started. He pointed out that Hill did not ask the witness crucial questions on the details of what she saw.

8: 45 a.m. Hill says an audio recording of the radio traffic shows that one of the officers said “Go ahead and set up a perimeter” at 11:31 a.m. that day. That audio was not part of Hill’s timeline, defense attorney Nico LaHood pointed out.

8:41 a.m. Judge Harle asks the defense and prosecution to stop the “table talk,” i.e. attorneys making their objections to each other. The judge asks all objections to be made directly to him.

8:40 a.m. Questioning continues over three Uvalde PD officers, Ofc. Saucedo, Coronado and Mendoza, who first arrived on the scene close to the time Adrian Gonzales arrived.

8:35 a.m. Former Texas Ranger Nick Hill is back on the witness stand to finish the cross examination. Hill is now with the Department of Homeland Security.

8:30 a.m. Testimony is expected to resume after court was adjourned Friday for the long weekend due to the MLK holiday.
