{"id":144778,"date":"2026-01-31T00:26:07","date_gmt":"2026-01-31T00:26:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/144778\/"},"modified":"2026-01-31T00:26:07","modified_gmt":"2026-01-31T00:26:07","slug":"city-denies-vehicle-damage-claims-tied-to-potholes-cites-limited-state-immunity","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/144778\/","title":{"rendered":"City denies vehicle damage claims tied to potholes, cites limited state immunity"},"content":{"rendered":"<p>EL PASO, Texas &#8211; (KFOX14\/CBS4) \u2014 Following heavy rains in El Paso, numerous potholes have emerged throughout the city, causing damage to vehicles. <\/p>\n<p>William Uptergrove, a lifelong El Paso resident, reported that his car was damaged after hitting a pothole on a rainy Sunday night. <\/p>\n<p>Uptergrove described the incident, saying, &#8220;I had come back later that night to photograph almost the entire thing of Chapstick fit inside this pothole. There, there&#8217;s little to no lighting on Resler.&#8221; <\/p>\n<p>He added that the deteriorated asphalt created a &#8220;hollow hole full of water&#8221; that was invisible while driving.<\/p>\n<p><p>Mark Baugh reports on City denies vehicle damage claims tied to potholes, cites limited state immunity (Credit: KFOX14)<\/p>\n<\/p>\n<p>RELATED: <a href=\"https:\/\/kfoxtv.com\/news\/local\/thousands-of-pothole-complaints-filed-in-el-paso-city-data-shows-drivers-claims-money-city-of-el-paso-city-council-street-maintenance-pothole-repair-data-reveals?src=link\" target=\"_blank\" rel=\"nofollow noopener\">Thousands of Pothole Complaints Filed in El Paso, City Data Shows<\/a><\/p>\n<p>Uptergrove recounted driving down Resler Drive near Bishop Flores Drive when he noticed a small bump. <\/p>\n<p>After stopping to inspect his vehicle, he initially found no tire damage. <\/p>\n<p>However, he later heard a squeaking noise from his front right tire and discovered a bend in the tire rim, which was releasing air.<\/p>\n<p>&#8220;If you don&#8217;t know how to change a tire, you&#8217;re sitting there until someone who can remove your vehicle can,&#8221; Uptergrove said.<\/p>\n<p>After reporting the incident to 311, Uptergrove was advised to submit a claim for vehicle damage through the city.<\/p>\n<p>However, his claim was denied under Texas Civil Practices and Remedies Code 101.021 (2). <\/p>\n<p>VIEW THE FULL CODE <a href=\"https:\/\/tcss.legis.texas.gov\/resources\/CP\/pdf\/CP.101.pdf#101?src=link\" target=\"_blank\" rel=\"nofollow noopener\">HERE<\/a><\/p>\n<p>El Paso City Attorney Karla Nieman explained, &#8220;There is a limited waiver of immunity under state law.
