{"id":152467,"date":"2026-02-05T18:22:12","date_gmt":"2026-02-05T18:22:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/152467\/"},"modified":"2026-02-05T18:22:12","modified_gmt":"2026-02-05T18:22:12","slug":"texas-am-professor-fired-for-gender-identity-lesson-sues","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/152467\/","title":{"rendered":"Texas A&#038;M professor fired for gender identity lesson sues"},"content":{"rendered":"<p>The Texas A&amp;M professor who was <a href=\"https:\/\/www.advocate.com\/news\/texas-professor-fired-gender-identity\" target=\"_blank\" rel=\"nofollow noopener\">fired for teaching about gender identity <\/a>has filed a lawsuit against the university, accusing officials of violating her First Amendment rights. <\/p>\n<p>Melissa McCoul went viral last summer when a student in her literature class objected to her correct statement that there are more than two genders, resulting in her being fired and dean of the College of Arts and Sciences and the head of the English department being <a href=\"https:\/\/www.advocate.com\/news\/texas-university-gender-studies-controversy\" target=\"_self\" rel=\"nofollow noopener\">removed from their administrative positions<\/a>. <\/p>\n<p>Related: <a href=\"https:\/\/www.advocate.com\/news\/texas-professor-fired-gender-identity\" target=\"_self\" rel=\"nofollow noopener\">Texas A&amp;M professor fired over discussion of gender identity <\/a><\/p>\n<p>Her <a href=\"https:\/\/file\/\/\/C:\/Users\/radamczeski\/Downloads\/gov.uscourts.txsd.2058319.1.0.pdf\" target=\"_blank\" rel=\"nofollow\">lawsuit<\/a>, filed Wednesday in the U.S. District Court for the Southern District of Texas, claims that the school not only violated her academic freedom, but &#8220;failed to honor a single one of the due process protections&#8221; guaranteed to professors. <\/p>\n<p>&#8220;Academic freedom is under attack,&#8221; the suit reads. &#8220;Professor Melissa McCoul was terminated because of the content of her course; content that was consistent with her syllabus, the course description, and the approved purpose of the course. Texas A&amp;M University ran roughshod over Dr. McCoul\u2019s due process rights in its haste to meet Texas Governor Greg Abbott\u2019s demand that the University fire her.&#8221;<\/p>\n<p>McCoul was fired after Republican state Rep. Brian Harrison posted a video of the incident, in which a student who was secretly recording disrupted her class by claiming the lesson was illegal under <a href=\"https:\/\/www.advocate.com\/donald-trump\" target=\"_self\" rel=\"nofollow noopener\">Donald Trump&#8217;s<\/a> executive order that <a href=\"https:\/\/www.advocate.com\/politics\/donald-trump-invalidates-transgender-identities\" target=\"_self\" rel=\"nofollow noopener\">recognizes only male and female sexes as assigned at birth<\/a>. The student also claimed the lesson violated her religious and moral beliefs, leading to a heated exchange with another student. McCoul then asked the student to leave, as she was impeding others&#8217; ability to learn.<\/p>\n<p>Texas does not have a law prohibiting educators from discussing race or LGBTQ+ identities in public universities. It does have a <a href=\"https:\/\/www.advocate.com\/dont-say-gay\" target=\"_self\" rel=\"nofollow noopener\">&#8220;Don&#8217;t Say Gay&#8221;<\/a> law for grades K-12 that not only bans mentioning sexual orientation and gender identity in classrooms, but goes even further by completely <a href=\"https:\/\/www.advocate.com\/politics\/texas-dont-say-gay-lgbtq-clubs\" target=\"_self\" rel=\"nofollow noopener\">outlawing LGBTQ+ student clubs<\/a>.<\/p>\n<p>The Texas A&amp;M University System has since<a href=\"https:\/\/www.advocate.com\/news\/texas-am-gender-ideology-ban\" target=\"_blank\" rel=\"nofollow noopener\"> banned professors from discussing<\/a> &#8220;race or gender ideology&#8221; in classrooms, though the decision was made after McCoul&#8217;s firing. The Board of Regents approved in November <a href=\"https:\/\/news.tamus.edu\/texas-am-university-system-strengthens-academic-oversight\/\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">policies<\/a> for its 12 universities that mandate &#8220;no academic course within the System may teach race or gender ideology or topics related to sexual orientation or gender identity, unless the course and its materials are approved in advance by a university president.&#8221;<\/p>\n<p>Related: <a href=\"https:\/\/www.advocate.com\/news\/texas-am-gender-ideology-ban\" target=\"_blank\" rel=\"nofollow noopener\">Texas A&amp;M bans teaching &#8216;race or gender ideology&#8217; at universities <\/a><\/p>\n<p>While Trump has signed <a href=\"https:\/\/www.advocate.com\/politics\/trump-orders-mass-dei-firings\" target=\"_self\" rel=\"nofollow noopener\">executive orders against DEI,<\/a> as well as declaring that there are only two sexes and <a href=\"https:\/\/www.advocate.com\/transgender\" rel=\"nofollow noopener\" target=\"_blank\">transgender<\/a> people don&#8217;t exist against medical and scientific consensus, these orders are not law and have been partially <a href=\"https:\/\/www.advocate.com\/news\/judge-blocks-trump-dei-ban\" target=\"_self\" rel=\"nofollow noopener\">blocked by a federal court<\/a>.<\/p>\n<p>McCoul is seeking front pay and back pay, as she was on the second year of a three-year contract, as well as compensatory damages and legal fees.
