EL PASO (KFOX14\/CBS4) – Artificial intelligence is making it easier than ever to manipulate photos and videos, but using AI to create \u201cdeepfakes\u201d can cross legal lines in Texas and New Mexico, according to personal injury attorney Omar Silver of the Labinoti Law Firm.<\/p>\n
Silver said AI deepfakes \u201ccan be illegal depending on certain circumstances,\u201d including \u201celection interference, harassment and stalking,\u201d \u201cnon-consensual sexual images,\u201d and \u201cfraud or impersonation.\u201d<\/p>\n
He said Texas has taken a particularly tough approach in some areas, adding, \u201cThey\u2019ve really cracked down on AI generated political and sexual depictions,\u201d and that \u201cthe law has been very clear that they will not tolerate these kind of AI deep fakes.\u201d<\/p>\n
For people who discover an AI-manipulated image of themselves online, Silver said the first step is to determine whether it falls into one of the categories that can trigger legal consequences, including \u201cdefamation, fraud, impersonation, harassment, stalking, election interference,\u201d or \u201cnon-consensual sexual images.\u201d<\/p>\n
\u201cIf it falls within those you report it to the police, make a report and have the authorities take it from there,\u201d Silver said.<\/p>\n
Silver noted that anonymous or \u201cghost\u201d accounts can complicate efforts to pursue a case. \u201cIn order for you to report it to the authorities or actually sue somebody civilly you have to know who you are suing or who are you pressing charges,\u201d he said.<\/p>\n
Even so, Silver said law enforcement can help guide victims through the process. \u201cThe authorities, if you reported the authorities, they would guide you and help you,\u201d he said, including \u201cways where they can help you take down the images.\u201d<\/p>\n
