Find out more at afa.org<\/p>\n<p>The use of a military counter-drone laser on the southwest border this week\u2014which prompted the Federal Aviation Administration to abruptly close the airspace over El Paso, Texas\u2014will be a \u201ccase study\u201d on the complex web of authorities needed to employ such weapons near civilian areas and the consequences of agencies failing to coordinate properly, experts say.<\/p>\n<p>The FAA ordered a 10-day shutdown of all flight traffic over El Paso after U.S. military units operating on the U.S.-Mexico border allowed U.S. Customs and Border Protection agents to use a military laser designed for counter-drone operations, according to <a href=\"https:\/\/apnews.com\/article\/faa-el-paso-texas-air-space-closed-1f774bdfd46f5986ff0e7003df709caa\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a report by the Associated Press<\/a> confirmed by Air &amp; Space Forces Magazine.\t\t<\/p>\n<p>The shutdown wound up lasting only a few hours before airspace was reopened, but the abrupt disruption to air traffic caused confusion and panic and quickly led to lawmakers and public officials demanding answers.<\/p>\n<p>Sen. Jack Reed (R.I.), the senior Democrat on the Senate Armed Services Committee, has called for answers, questioning whether proper safety protocols were followed, and why public communications \u201cappear to have been inconsistent\u201d about what occurred over El Paso.<\/p>\n<p>\u201cThe airspace closure over El Paso triggered immediate chaos and confusion and cannot be dismissed as a minor misunderstanding, Reed wrote in a <a href=\"https:\/\/www.reed.senate.gov\/news\/releases\/reed-seeks-urgent-answers-on-el-paso-airspace-closure\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Feb. 11 statement<\/a>. \u201cThe conflicting accounts coming from different parts of the federal government only deepen public concern and raise serious questions about coordination and decision-making.\u201d<\/p>\n<p>U.S. officials have provided few official details about the incident except to say it involved Mexican drug cartels flying drones at the border. Department of Transportation Secretary Sean Duffy said the FAA and the Pentagon \u201cacted swiftly to address a cartel drone incursion,\u201d according to <a href=\"https:\/\/x.com\/secduffy\/status\/2021594420806639787?s=43\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Feb. 11 post on X<\/a>.<\/p>\n<p>U.S. Northern Commander\u2019s Air Force Gen. Gregory M. Guillot told lawmakers in March 2024 that roughly <a href=\"https:\/\/www.war.gov\/News\/News-Stories\/Article\/Article\/3707785\/norad-commander-incursions-by-unmanned-aircraft-systems-on-southern-border-like\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">1,000 incursions by unmanned aircraft systems<\/a> occur daily along the U.S.-Mexico border.\t\t<\/p>\n<p>The incident is the latest high-profile example of the threats drones\u2014even small, cheap ones\u2014present to the U.S. homeland. While this threat was at the border near the Army\u2019s Fort Bliss, the Air Force has been dealing with the issue since December 2023, when <a href=\"https:\/\/www.airandspaceforces.com\/drone-swarms-new-threat-us-bases\/\" rel=\"nofollow noopener\" target=\"_blank\">unidentified drone swarms flew unchecked over Joint Base Langley-Eustis<\/a>, Va., for several days. Other drone incursions followed <a href=\"https:\/\/www.airandspaceforces.com\/small-drone-incursions-air-force-bases-utah-ohio-germany\/\" rel=\"nofollow noopener\" target=\"_blank\">over air bases in Ohio, Utah<\/a>, and other locations, compelling the Air Force and its sister services to place a top priority on finding ways to detect, identify, track and, if necessary, bring down these small, inexpensive drones. <\/p>\n<p>Last year, the Pentagon began scrambling to <a href=\"https:\/\/www.airandspaceforces.com\/pentagon-rushing-to-find-low-collateral-tech-to-counter-hostile-drones\/\" rel=\"nofollow noopener\" target=\"_blank\">buy low-collateral counter-drone technology<\/a> that\u2019s safe to use near populated areas, and the Air Force and other services have been investing hundreds of millions on counter-drone weapons.<\/p>\n<p><a href=\"https:\/\/www.airandspaceforces.com\/pentagon-rushing-to-find-low-collateral-tech-to-counter-hostile-drones\/\" rel=\"nofollow noopener\" target=\"_blank\">Experts that have followed the government\u2019s counter-drone effort<\/a> <a href=\"https:\/\/www.airandspaceforces.com\/pentagon-rushing-to-find-low-collateral-tech-to-counter-hostile-drones\/\" rel=\"nofollow noopener\" target=\"_blank\">have warned<\/a> that using such weapons will require coordination with the FAA and other agencies. Now, those same experts are cringing at the apparent lack of coordination between the Pentagon and FAA.<\/p>\n<p>\u201cIn terms of interagency coordination, this is a pretty bad scenario. \u2026 There was a failure to communicate between the military, CBP\u2014which was actually using the laser, I understand\u2014and the FAA,\u201d said Henry Ziemer, an associate fellow at the Center for Strategic and International Studies. \u201cThis is a case study in how not to do it.\u201d<\/p>\n<p>Zeimer, who has focused on criminal organizations in Latin America, recently wrote a <a href=\"https:\/\/www.csis.org\/analysis\/united-states-needs-southwest-drone-wall\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">CSIS commentary<\/a> on the need for a \u201cdrone wall\u201d to counter drone usage by drug cartels on the southwest border.\t\t<\/p>\n<p>\u201cCriminal organizations are nothing if not adaptable, and so when you see a crackdown in one area, like we\u2019ve seen on sort of land crossings along the border, they adapt,\u201d Zeimer said. \u201cDrones have been super useful in that regard and allow cartels to survey large stretches of the border to try and identify where the border patrol presence is and reorient their routes and figure out where to go next.\u201d<\/p>\n<p>\u201cMost of the incursions don\u2019t cross into U.S. airspace, but they\u2019re hovering right just outside, observing the border patrols \u2026 and figuring out where they are,\u201d he added.<\/p>\n<p>A key challenge of countering the drone threat over military installations has been ensuring military commanders have the proper authorities they need to bring down potentially hostile drones if necessary. While details are still emerging, the Feb. 11 incident occurred in the area of Fort Bliss, Texas, which now sits adjacent to a new \u201cNational Defense Area\u201d that runs between Bliss and the Southwest border for the purpose of \u201cdenying illegal activity along the southern border,\u201d according to a <a href=\"https:\/\/www.northcom.mil\/Newsroom\/Press-Releases\/Article\/4171767\/second-national-defense-area-established-in-texas\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">May 2025 NORTHCOM announcement<\/a>.<\/p>\n<p>The Pentagon\u2019s Joint Inter-Agency Task Force 401, which focuses on finding counter-drone solutions, recently published <a href=\"https:\/\/www.war.gov\/News\/Releases\/Release\/Article\/4389392\/jiatf-401-announces-updated-guidance-to-counter-drone-threats-in-the-homeland\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">updated guidance<\/a> designed to empower \u201cinstallation commanders to take decisive action to protect military facilities, assets, and personnel within the homeland.\u201d<\/p>\n<p>The new guidance is designed to streamline policies for counter-drone operations under authority of U.S. law governing the protection of certain facilities and assets from drones, by providing commanders with more options such as allowing drone-defense activities to go beyond an installation\u2019s fenceline, according to the document.\t\t<\/p>\n<p>Stacie Pettyjohn, director of the Defense Program at the Center for a New American Security,\u00a0acknowledged the efforts the Pentagon has undertaken to counter drones over the U.S., but she said the incident in El Paso points to a lack of coordination and \u201cshows how ill-prepared the U.S. Government writ large is for the small drone threat.\u201d<\/p>\n<p>\u201cIn trying to strip away some of the red tape, they\u2019ve moved fast and haven\u2019t necessarily ensured that the level of coordination that\u2019s needed for some of these weapons to be employed,\u201d Pettyjohn said, adding that she questions the decision to allow CBP members to employ counter-drone laser near a heavily traveled air corridor.<\/p>\n<p>\u201cCan you imagine if a laser hit a civilian airliner?\u201d said Pettyjohn, who recently co-authored a <a href=\"https:\/\/www.cnas.org\/publications\/reports\/countering-the-swarm\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">CNAS report<\/a> on protecting the joint force in the drone age. \u201cIt\u2019s not just that the laser would damage an aircraft, it could blind the pilots and just cause an accident.\u201d<\/p>\n<p>It\u2019s still unclear what laser technology was used in the El Paso drone incident. <a href=\"https:\/\/www.reuters.com\/business\/aerospace-defense\/aerovironments-locust-counter-drone-laser-used-by-us-army-near-el-paso-airport-2026-02-12\/?taid=698dbaee2970a800019f0ff8&amp;utm_campaign=trueAnthem:+Trending+Content&amp;utm_medium=trueAnthem&amp;utm_source=twitter\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Reuters reported<\/a> that the Army had deployed AeroVironment Inc\u2019s LOCUST laser counter-drone weapon system near El Paso International Airport. AeroVironment <a href=\"https:\/\/www.avinc.com\/resources\/press-releases\/view\/av-delivers-jltv-mounted-locust-laser-weapon-systems-to-u.s-army\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">delivered two<\/a> Joint Light Tactical Vehicle equipped with 20 kilowatt laser systems to the Army in December as part of the second increment of the Army Multi-Purpose High Energy Laser prototyping effort. The Army has conducted numerous tests of its <a href=\"https:\/\/www.army.mil\/article\/286677\/us_army_tests_laser_weapons_aiming_at_a_future_of_energy_based_air_defense\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Directed Energy Maneuver-Short Range Air Defense<\/a>, or DE M-SHORAD,\u00a0that\u2019s equipped with a 50-kilowatt laser for counter-drone operations.<\/p>\n<p>Air &amp; Space Forces Magazine reached out to the Pentagon and NORTHCOM for this story. NORTHCOM deferred to the Pentagon, which did not respond to the query by press time.\t\t<\/p>\n<p>Pettyjohn questions the amount of training CBP members received before being cleared to use such as weapon. Military air defense units have \u201cdeep expertise\u201d in the capabilities of counter-drone laser weapons, which has come through years of testing, she said.<\/p>\n<p>\u201cI think this does highlight the risks of transferring advanced weapons system to Customs and Border Pretection agents, who are not trained on it necessarily and might not be as aware of some of the potential risks of employing these,\u201d Pettyjohn said.<\/p>\n<p>Pettyjohn said she thinks it\u2019s appropriate for Pentagon officials to accept risk in trying to change some of the restrictions on using counter-drone systems in the U.S., \u201cbut they\u2019re accepting a lot of risk by transferring them to someone else to use.\u201d<\/p>\n<p>\u201cI think this does highlight questions about the appropriate roles of missions between the Department of Homeland Security and the Pentagon for this \u2026 and I think there needs to be clear guardrails for employing different types of counter-drone defeat systems in the U.S.,\u201d Pettyjohn said. \u201cIs the laser the appropriate system to be using on the border or for a base?
