accused of opening fire<\/a> inside a Garland convenience store the day after Christmas\u2014 killing three teenagers, injuring a fourth \u2014 and then vanishing.\u00a0<\/p>\nFive years later, Abel Acosta is still on the run.<\/p>\n
\nDec. 26, 2021: A deadly encounter <\/p>\n
Garland police say the first calls came in reporting multiple people shot at a convenience store near Glenbrook and Walnut.<\/p>\n
Officers found four victims inside \u2014 three dead and one critically wounded.\u00a0<\/p>\n
Surveillance video from inside and outside the store was clear and disturbing. Detective Lucas Shupe, the lead detective on the case, said the video shows a pickup truck pulling into the lot with two occupants: an adult male driver and a juvenile passenger.<\/p>\n
In the video, you see the adult \u2014 later identified as Richard Acosta \u2014 go into the store first. He purchased something small and looked toward a group of teens inside. He then returned to the truck and began talking with the juvenile male. The two appeared to point toward people inside the store.<\/p>\n
Shupe said the truck backed up, circled around the store through the fuel pumps, briefly moved off camera, then returned.<\/p>\n
When the juvenile exited the truck, he was no longer wearing it and was carrying a gun. Surveillance later showed he \u201cput on a baseball cap, removed his shirt, and put on a mask,” said Shupe.\u00a0<\/p>\n
\u201cIt appears to me that steps were taken based upon surveillance video that he concealed his identity,” Shupe said. \u201cIt tells me he has enough thought process that he is thinking about what is about to happen, and he doesn\u2019t want to be identified.\u201d<\/p>\n
As soon as the door opened, the gun was inside the store.<\/p>\n
\u201cAs soon as the door\u2019s opening, the gun\u2019s inside the store, he starts shooting,\u201d Shupe said.<\/p>\n
Investigators say one of the victims, 14-year-old Xavier Gonzalez, \u201cwas not in any way, shape or form associated with these kids. He was just sitting down on the chair waiting for his food order to get completed,” said Pedro Barineau, Garland Police PIO.<\/p>\n
Another victim, 17-year-old Rafael Garcia, was remembered by his sister as someone who \u201cloved playing soccer, he loved playing football,\u201d and \u201che would go into my mom\u2019s room just to tell her how much he loved her.\u201d<\/p>\n
A third teen was also killed. A 15-year-old employee was cooking in the back when the gunfire erupted.<\/p>\n
The surviving victim, the cook, was shot and critically injured. His family later described the chaos inside the store: \u201cShe was dialing, and I don\u2019t know what was happening from there. I was only worried about breathing.”<\/p>\n
\nMotive\u00a0 <\/p>\n
Investigators say Abel Acosta was part of a gang. At least two of the victims had once been acquaintances.<\/p>\n
Shupe said investigators believed the relationships had fractured months before the shooting and that prior incidents had occurred between the groups. Authorities do not believe it was a random attack \u2014 but they say one innocent bystander paid the ultimate price.<\/p>\n
\u201cAll he was going to do was pick up food for his family, and he didn\u2019t make it home because someone made a bad decision,\u201d a family member said.<\/p>\n
\nThe father\u2019s role <\/p>\n
Richard Acosta, Abel\u2019s father, was charged with capital murder for his alleged role in aiding his son.<\/p>\n
Prosecutors argued he \u201cdirected aided, in the execution of those 3 boys,\u201d \u00a0said Stephanie Fargo, prosecutor.<\/p>\n
The defense countered, \u201cWe are saying he didn\u2019t know he aided his son before, during or after this offense,” said Heath Harris, defense attorney.<\/p>\n
Harris argued, \u201cHearing shots does not mean that he saw what happened\u2026 he told you he didn\u2019t see it.\u201d<\/p>\n
Another defense claim stated, \u201cI just know he didn\u2019t know he had a gun when he went into the store.\u201d<\/p>\n
Prosecutors said surveillance showed the truck circling, stopping and positioning before the shooting \u2014 and that Richard Acosta drove away quickly afterward.<\/p>\n
\u201cAble got out of the truck, goes in there in public, opens fire in the store, and he goes back to the truck and the truck drives away. So the fact that he drove away quickly, he knew that\u2019s why he\u2019s also being charged with capital murder,” Barineau said.<\/p>\n
After deliberations, a jury convicted Richard Acosta. He was sentenced to life without parole.<\/p>\n
One family member said, \u201cThat night changed our lives forever \u2014 today was only half the justice he deserved. I hope Abel is also brought to justice.\u201d<\/p>\n
Dallas County District Attorney John Creuzot said, \u201cWe are never going to stop looking for his son and we will continue to look.\u201d<\/p>\n
\nThe manhunt <\/p>\n
Five years later, Abel Acosta remains missing.<\/p>\n
\u201cWe still have a kid out there responsible for it,\u201d Shupe said. \u201cI would consider it still a danger to the public.\u201d<\/p>\n
Authorities believe he did not escape alone.<\/p>\n
\u201cSomeone is helping him\u2026 whose helping him? That is still unknown,\u201d Shupe said. \u201cIt\u2019s actually pretty infuriating. I did not think a 14-year-old could be gone this long. I really did not.\u201d<\/p>\n
Investigators have worked with federal partners, including the U.S. Marshals and FBI, to track down leads across the country and possibly beyond. Digital evidence and tips have been analyzed, but Shupe said, \u201cIt has been over 5 years now, and we do not know his location.\u201d<\/p>\n
Some speculate he may be dead. Shupe disagrees.<\/p>\n
\u201cIt is my opinion, I\u2019ve maintained from the beginning, that he is alive,” he said.<\/p>\n
Police have evidence that the family made trips to Mexico in the past, and both sides may have relatives there. However, Shupe cautions against assumptions that he is definitively outside the U.S.<\/p>\n
\u201cI don\u2019t want the public to just make the assumption that he\u2019s out of the country and quit looking and quit noticing and quit reporting,\u201d he said.\u00a0<\/p>\n
Authorities believe someone knows something.<\/p>\n

\nThe families still waiting <\/p>\n
For the families of Xavier Gonzalez, Ivan Noyala and Rafael Garcia, justice remains incomplete.<\/p>\n
\u201cRight now we are his voice, and we are here to get justice,\u201d said one aunt during the trial.<\/p>\n
Another family member said, \u201cWe didn\u2019t realize how much of an impact he had until we lost him \u2014 not in a million years did he deserve what your son did and the actions you took to aid him.\u201d<\/p>\n
Five years later, memorials still stand. Birthdays are still marked without them.<\/p>\n
And somewhere, investigators believe, the now-grown fugitive is still out there.<\/p>\n
