If Jim Baxa becomes Lubbock\u00a0County Clerk, he will not sign a marriage certificate for same-sex couples\u00a0but also would not\u00a0stop\u00a0someone else in the office from signing one, he told LubbockLights.com<\/a> the day after a candidate forum.\u00a0<\/p>\n

Susan Rowley, Justice of the Peace for Precinct 2,\u00a0asked Baxa and his\u00a0fellow Republican\u00a0opponents in the March 3 Texas primary election \u2013 Sandy Garcia and Rebeca Gonzales\u00a0\u2013 about the issue at the\u00a0South Overton\u00a0forum attended by about 20 people\u00a0which\u00a0also\u00a0featured\u00a0candidates in other races.\u00a0<\/p>\n

\u201cI said, \u2018Can you all three answer yes or no? Are you planning\u00a0on giving, allowing marriage licenses to people that are the same sex?\u2019\u201d Rowley said to LubbockLights.com the day after.\u00a0<\/p>\n

Garcia and Gonzales said they would. Baxa\u2019s answer was more\u00a0nuanced.\u00a0<\/p>\n

\u201cMy compliance with that is under duress at this point,\u201d Baxa said to LubbockLights.com the following day.\u00a0<\/p>\n

Baxa and Rowley disagreed on what law should get higher priority \u2013 Texas or\u00a0the U.S. Supreme Court \u2013 following the High Court\u2019s 2015 Obergefell v. Hodges ruling.<\/p>\n

Rowley, who is both an incumbent Justice of the Peace and attorney, said, \u201cHe thinks the Supreme Court was wrong and that Texas has it right. And he\u00a0doesn\u2019t\u00a0care what the Supremacy Clause of the Constitution says.\u201d\u00a0<\/p>\n

\u201cThe Supremacy Clause refers to the foundational principle that, in general, federal law takes precedence over any conflicting state law.\u201d\u00a0<\/p>\n

Baxa has been open about his opposition to same sex marriage, Rowley said, so she wanted to ask the\u00a0question.\u00a0<\/p>\n

\u201cHe\u2019s professed\u00a0himself. He spoke all the time about how \u2026 no wedding should be with the same sex,\u201d Rowley said.\u00a0\u00a0<\/p>\n

Baxa said, \u201cIt was definitely an ambush by some Democrats and one moderate Republican that were at that event that were ready to attack me on that issue.\u201d\u00a0<\/p>\n

Baxa also told LubbockLights.com\u00a0he\u2019s\u00a0the real conservative in the race while one of his opponents said he\u00a0doesn\u2019t\u00a0really understand how the clerk\u2019s office works, which\u00a0we\u2019ll\u00a0get into more detail below.\u00a0<\/p>\n

This stems from Obergefell v. Hodges in 2015\u00a0<\/p>\n

Baxa\u2019s\u00a0\u201cduress\u201d\u00a0comes from a 2015 United States\u00a0Supreme Court ruling in Obergefell v. Hodges. The high court ruled states must offer marriage to couples\u00a0of the same sex.\u00a0\u00a0\u00a0<\/p>\n

The Supreme Court was wrong in their interpretation when they made the Obergefell decision. And the law of the land is not written by courts but is written by legislatures.<\/p>\n

Baxa recalled his answer to\u00a0the\u00a0forum, saying,\u00a0\u201cI said the law of the land is the Texas Constitution, which says that marriage is a union between a man and a woman only. And the Supreme Court was wrong in their interpretation when they made the Obergefell decision. And the law of the land is not written by courts but is written by legislatures.\u201d\u00a0\u00a0<\/p>\n

Shortly after the Obergefell ruling, a Texas Attorney General opinion said, \u201cA federal district court \u2026 enjoined the state from enforcing Texas laws that define marriage as exclusively a union between one man and one woman.\u201d\u00a0<\/p>\n

That same opinion said clerks across the state could make accommodations for an employee who did not want to issue a same-sex marriage certificate. But same-sex couples were entitled to the \u201csame terms\u201d of marriage as opposite-sex couples, the opinion further explained.\u00a0\u00a0<\/p>\n

Baxa explained he would not force an employee of the clerk\u2019s office to sign a same-sex marriage certificate, but he would not prevent employees from signing either.\u00a0\u00a0\u00a0<\/p>\n

\u201cThat would be up to their\u00a0consciences,\u201d Baxa said.\u00a0<\/p>\n

While Baxa said he would not likely be called upon to sign\u00a0a certificate, others in the office would.\u00a0He said there would be no reason for a lawsuit\u00a0against Lubbock County\u00a0if he wins election as county clerk\u00a0because one way or another the clerk\u2019s office would\u00a0provide the marriage certificate to a same-sex couple.\u00a0\u00a0<\/p>\n

I\u00a0don\u2019t\u00a0want any Lubbock County citizen feeling like\u00a0they\u2019re\u00a0going to walk into the county clerk\u2019s\u00a0office\u00a0and\u00a0they\u2019re\u00a0going to\u00a0feel ashamed. <\/p>\n

Garcia\u00a0saw the issue differently\u00a0when she spoke to LubbockLights.com\u00a0\u00a0<\/p>\n

\u201cNumber one,\u00a0we\u2019re\u00a0going to follow the law. Number two, I\u00a0don\u2019t\u00a0want any Lubbock County citizen feeling like\u00a0they\u2019re\u00a0going to walk into the county clerk\u2019s\u00a0office\u00a0and\u00a0they\u2019re\u00a0going to\u00a0feel ashamed. Everyone is welcome,\u201d\u00a0Garcia\u00a0said.\u00a0\u00a0<\/p>\n

When I started in the office, I took an oath to uphold what would be\u00a0required of\u00a0me to do my job.<\/p>\n

Gonzales told LubbockLights.com, \u201cWhen I started in the office, I took an oath to uphold what would be\u00a0required of\u00a0me to do my job. I have\u00a0my faith, and I have\u00a0my beliefs. And it is part of my job, and\u00a0I\u2019ll\u00a0do it because\u00a0it\u2019s\u00a0part of my duty.\u201d\u00a0<\/p>\n

\u201cIt is one of the questions asked during an interview process. One of the things that we\u00a0have to\u00a0do in this job is issue licenses to same-sex couples.\u00a0\u2018Will that be a problem for you?\u2019\u00a0\u2026 If it were to be an issue to someone, then we could see if\u00a0there\u2019s\u00a0another position that they might want to work in,\u201d Gonzales said.\u00a0\u00a0<\/p>\n

Baxa said\u00a0he wants his answer to show the separation between himself \u2013 \u201cthe conservative\u201d and \u201cmy two opponents as more moderate persons.\u201d\u00a0\u00a0<\/p>\n

\u201cOne of them\u00a0stated\u00a0that she has been signing these as a low-level clerk and has no problem with signing them. \u2026\u00a0The other one\u00a0actually seemed\u00a0to be celebrating the position of same-sex marriage,\u201d\u00a0Baxa said.\u00a0\u00a0<\/p>\n

Garcia\u00a0said,\u00a0\u201cHe kept trying to basically say that it wasn\u2019t a law, that only Congress can pass a law.\u201d\u00a0\u00a0<\/p>\n

Baxa said, \u201cI\u00a0actually disagree\u00a0with the concept that is foreign to our\u00a0Constitution that courts get to decide what is constitutional and what is not. That is actually left to the states and the people by the 10th Amendment because the Constitution is silent on who decides what is\u00a0constitutional.\u00a0\u2026\u00a0The federal court cannot ever overrule the Texas Constitution.\u201d\u00a0<\/p>\n

Running the clerk\u2019s office\u00a0<\/p>\n

Baxa believes his conservatism goes further than just one issue as\u00a0he\u2019d\u00a0like to find ways to spend less money.\u00a0\u00a0\u00a0<\/p>\n

\u201cMy opponents want to spend more of the taxpayer money on the county clerk\u2019s office by hiring more employees and giving those employees raises\u00a0as well as spending more on supplies in the office.\u00a0Whereas,\u00a0I want to control spending, become more efficient so that we need fewer employees, not more,\u201d\u00a0Baxa said.\u00a0\u00a0<\/p>\n

Garcia said Baxa has a misunderstanding of how many employees work in the office and how much money it takes to\u00a0maintain\u00a0quality service.\u00a0\u00a0<\/p>\n

\u201cThe jobs that we do affect everyone in Lubbock County at some point in their\u00a0life. I want to know that whoever is running that understands the office. \u2026 You\u00a0don\u2019t\u00a0want someone to come in that really has no idea as to what we do,\u201d Garcia said.\u00a0\u00a0<\/p>\n
