{"id":177198,"date":"2026-02-24T00:12:08","date_gmt":"2026-02-24T00:12:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/177198\/"},"modified":"2026-02-24T00:12:08","modified_gmt":"2026-02-24T00:12:08","slug":"federal-judge-temporarily-blocks-plano-isd-from-enforcing-parts-of-texas-law-banning-dei","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/177198\/","title":{"rendered":"Federal judge temporarily blocks Plano ISD from enforcing parts of Texas law banning DEI"},"content":{"rendered":"<p class=\"body-text-paragraph\">A federal judge temporarily blocked three school districts, including <a href=\"https:\/\/www.pisd.edu\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.pisd.edu\/\">Plano ISD<\/a>, from implementing parts of a new <a href=\"https:\/\/www.dallasnews.com\/news\/education\/2025\/07\/22\/how-will-the-texas-dei-ban-change-public-schools\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.dallasnews.com\/news\/education\/2025\/07\/22\/how-will-the-texas-dei-ban-change-public-schools\/\">Texas law restricting diversity, equity and inclusion programming<\/a> in public schools last week. <\/p>\n<p class=\"body-text-paragraph\">Judge Charles Eskridge with the U.S. District Court for the Southern District of Texas in Houston barred the districts \u2014 <a href=\"https:\/\/www.houstonisd.org\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.houstonisd.org\/\">Houston<\/a>, <a href=\"https:\/\/www.katyisd.org\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.katyisd.org\/\">Katy<\/a> and Plano ISDs \u2014 on Friday from enforcing portions of Senate Bill 12. The law, which took effect Sept. 1, prohibits public schools from sponsoring gender and sexuality alliance clubs and rolls back programming related to race, gender and sexual orientation.<\/p>\n<p class=\"body-text-paragraph\">\u201cThis is a critical victory amidst a surge of state-sponsored discrimination,\u201d Brian Klosterboer, an attorney for the American Civil Liberties Union of Texas, said in a news release. \u201cWe will continue advocating for the rights of every student, parent and educator in Texas to be able to live and speak freely, authentically and safely in and surrounding K-12 schools.\u201d<\/p>\n<p class=\"body-text-paragraph\">The temporary block only applies to those three districts. Texas Education Commissioner Mike Morath and Plano, Houston and Katy ISDs were named as defendants. <\/p>\n<p class=\"body-text-paragraph\">Court documents show that at least one Gender and Sexuality Alliance group in Plano ISD disbanded ahead of the law\u2019s implementation. One student decided to be homeschooled because the club shut down \u201cand the fact that their affirming name and pronouns will no longer be respected by teachers and staff,\u201d court documents read.<\/p>\n<p class=\"body-text-paragraph\"><a href=\"https:\/\/www.dallasnews.com\/news\/education\/2026\/01\/07\/what-to-know-as-texas-aft-sues-texas-over-kirk-teacher-investigations\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.dallasnews.com\/news\/education\/2026\/01\/07\/what-to-know-as-texas-aft-sues-texas-over-kirk-teacher-investigations\/\">Texas AFT<\/a>, the teachers\u2019 union, said it has already received a \u201chigh volume of inquiries\u201d from members about the law\u2019s meaning and worried about its \u201charsh professional consequences.\u201d <\/p>\n<p>Related<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" style=\"aspect-ratio:190 \/ 127\" class=\"dmnc_features-article-body-embeds-related-story-module__2UraD flex-none object-cover dmnc_images-modern-image-module__QFaG- max-w-full h-auto text-white dmnc_images-modern-image-module__9Zlll bg-gray-light object-contain dmnc_images-modern-image-module__P3kZ4 w-full\" width=\"190\" height=\"127\" src=\"https:\/\/www.newsbeep.com\/us-tx\/wp-content\/uploads\/2026\/02\/BKO2LSPP2RGWXEXNGZAS2X4PAM.JPG\" alt=\"Crowd enjoy a drag performance during Arlington Pride, on Saturday, June 14, 2025 in Arlington.\"\/><\/p>\n<p class=\"body-text-paragraph\">Among other provisions of SB 12, schools cannot instruct, guide or offer programming on LGBTQ identity. Nor can they assist transgender children in social transitioning, including using new names or pronouns, according to the law. Critics have compared Texas\u2019 law to Florida\u2019s \u201cDon\u2019t Say Gay\u201d law, which prohibits discussing homosexuality in schools. <\/p>\n<p class=\"body-text-paragraph\">The law also bars schools from discussions and hosting events related to racial identity, like programming celebrating Black, Latino, Asian and Indigenous history and training on cultural awareness. <\/p>\n<p class=\"body-text-paragraph\">Eskridge also removed Morath from the lawsuit, ruling that plaintiffs \u201clack standing to pursue action against him.\u201d He determined the plaintiffs could not prove their alleged injuries were \u201ctraceable\u201d to Morath. <\/p>\n<p class=\"body-text-paragraph\">The judge said the three districts did not give their position on the merits of the law.
