The Department of Homeland Security said the man entered the United States on a tourist visa in 2000, became a lawful permanent resident by marrying a U.S. citizen in 2006 and was naturalized in 2013.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Shortly before 2 a.m. Sunday, the gunman killed two people and injured 14 others at a bar that sits among several popular nightlife venues on West 6th Street.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Many Texas Republicans, including Gov. Greg Abbott, suggested the <a href=\"https:\/\/x.com\/GregAbbott_TX\/status\/2028186869914063251?s=20\" rel=\"nofollow\">gunman wasn\u2019t properly backgrounded<\/a> before he was granted U.S. citizenship, but did not provide details of what should have prevented his naturalization. When asked about his criminal history, DHS only said the man was arrested in Texas in 2022, after he was a citizen, for \u201ccollision with vehicle damage,\u201d a misdemeanor crime typically given when someone leaves the scene of a wreck.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The New York Post <a href=\"https:\/\/nypost.com\/2026\/03\/01\/us-news\/austin-mass-shooter-ndiaga-diagne-became-citizen-despite-string-of-busts\/\" rel=\"nofollow noopener\" target=\"_blank\">reported<\/a> that gunman, 53-year-old Ndiaga Diagne, was arrested for \u201cillegal vending\u201d in New York City in 2001. Citing unnamed sources, The Post said he was arrested in New York three other times between 2008 and 2016, but those cases are sealed. The Post did not report on whether he was convicted of any crimes. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">At least one GOP candidate for attorney general has called for an audit into immigrants who are in the country legally. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cAudit all \u2018legal\u2019 immigrants\u2019 papers and deport as many as possible,\u201d Aaron Reitz <a href=\"https:\/\/x.com\/aaron_reitz\/status\/2028184179763261547?s=20\" rel=\"nofollow\">said<\/a> on X. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Reitz and others also voiced their opposition to Islam, which has become a key campaign pillar for some Texas Republicans competing in Tuesday\u2019s GOP primary. The gunman wore a sweatshirt emblazoned with the words \u201cProperty of Allah\u201d and a shirt with a design of the Iranian flag, according to the Associated Press. The shooting happened after the United States and Israel bombed Iran. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Austin police did not disclose a motive for the shooting, but the FBI is investigating it as a potential act of terrorism, the Associated Press reported late Sunday. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The Texas chapter of the Council on American-Islamic Relations, an American Muslim civil rights group, condemned the attack in a <a href=\"https:\/\/www.cair.com\/press_releases\/cair-texas-and-austin-muslim-community-extend-prayers-condolences-to-families-impacted-by-deadly-shooting\/\" rel=\"nofollow noopener\" target=\"_blank\">statement<\/a> Sunday and rejected any efforts to blame the whole community based on one individual\u2019s action. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWe encourage elected officials, law enforcement, faith leaders, and community members to come together to support the families of the victims and reaffirm our shared commitment to public safety,\u201d the organization\u2019s statement said.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Abbott and state Rep. <a href=\"https:\/\/directory.texastribune.org\/james-talarico\/\" rel=\"nofollow noopener\" target=\"_blank\">James Talarico<\/a>, an Austin Democrat running for U.S. Senate, quarreled on X about the shooting. Abbott said that \u201callowing unvetted immigrants who are hostile to America, who are loyal to our adversaries like Iran, must end. This was an act of terror, James.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cThe way to end it is to end the current open immigration policies,\u201d he continued. \u201cYou and your immigration policies would make America less safe.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Talarico responded to Abbott by saying \u201cdangerous people should not be allowed into the country. Dangerous people should not be allowed to get guns. Texans understand this \u2014 you apparently don\u2019t.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Austin Police Association President Michael Bullock criticized Talarico <a href=\"https:\/\/x.com\/MBullockATX\/status\/2028300944992047225?s=20\" rel=\"nofollow\">on X<\/a> for politicizing the incident. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWith all due respect sir \u2013 now is not the time. All of the information has not come out. How can policy be made on incomplete information?\u201d he said. \u201cThe action that needed to happen did \u2013 officers heroically ended the violence.\u201d <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cThis applies to all candidates and elected officials regardless of party,\u201d he continued. \u201dNow is the time to focus on the victims and first responders impacted, not campaigns.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">U.S. Rep. Chip Roy, who is also running for the GOP nomination to be state attorney general, <a href=\"https:\/\/x.com\/chiproytx\/status\/2028230807093903807?s=20\" rel=\"nofollow\">posted<\/a> alleged details about the gunman\u2019s immigration to America and naturalization. He said the gunman was granted legal residency during George W. Bush\u2019s administration, \u201camid GOP celebration of the joys of \u2018melting pot\u2019 legal immigration.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cThis is why we are losing our country, our immigration system is a joke, and should PAUSE ALL immigration,\u201d Roy said. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Naturalization is the legal process of becoming a citizen after meeting certain requirements. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Denise Gilman, director of the Immigration Clinic at the University of Texas at Austin, said there has long been extensive vetting in the naturalization process, including criminal background checks. She also said immigrants can\u2019t immediately become citizens without first going through prior steps, such as becoming a lawful permanent resident, that require scrutiny.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cNaturalization is just the last step of many steps that all require vetting,\u201d she said.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Immigrants are <a href=\"https:\/\/acf.gov\/ocs\/fact-sheet\/liheap-fact-sheet-how-become-united-states-citizen#:~:text=To%20be%20eligible%20for%20U.S.%20citizenship%2C%20you%20must%3A&amp;text=You%20may%20submit%20an%20Application,ordinary%20English%20words%20and%20phrases.\" rel=\"nofollow noopener\" target=\"_blank\">eligible for naturalization<\/a> if they are 18 years old or older and have been green card holders for at least five years (three years if they are married to a U.S. citizen). They also have to take tests proving they\u2019re able to speak, read and write in English. As of last fall, the Trump administration <a href=\"https:\/\/www.npr.org\/2025\/10\/16\/nx-s1-5566732\/the-trump-administration-is-rolling-out-changes-to-the-u-s-citizenship-test\" rel=\"nofollow noopener\" target=\"_blank\">added more requirements<\/a>, such as a more rigorous <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/questions-and-answers\/2025-Civics-Test-128-Questions-and-Answers.pdf\" rel=\"nofollow noopener\" target=\"_blank\">civics test<\/a>, and having to prove to an immigration officer that they are \u201ca person of good moral character.\u201d <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">When asked about Diagne\u2019s reported arrests, Gilman said generally arrests can be considered when evaluating moral character or discretion but will not automatically bar green card status or naturalization. Certain convictions, however, may result in actual bars.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cIt really depends on the nature of the crimes involved,\u201d she said.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Around <a href=\"https:\/\/www.uscis.gov\/citizenship-resource-center\/naturalization-statistics\" rel=\"nofollow noopener\" target=\"_blank\">818,500 people were naturalized<\/a> in the fiscal year of 2024, according to U.S. Citizenship and Immigration Services, which has not published 2025 data yet \u2014 nearly 10% lived in Texas. The total was a 7% decrease from 2023, the agency said. From 2022 to 2024, the country has added more than 2.6 million new citizens through naturalization.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">U.S. Sen. John Cornyn, who <a href=\"https:\/\/www.texastribune.org\/2026\/02\/28\/john-cornyn-ken-paxton-wesley-hunt-texas-senate-primary-republican\/\" rel=\"nofollow noopener\" target=\"_blank\">is up for reelection this year<\/a>, said on Fox News that the shooting underscores \u201cthe importance of vetting people before they come across the border,\u201d and is an example of \u201cwhat happens when people become radicalized.\u201d <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Cornyn blamed the Biden administration for having \u201copen border policies that let who knows what into the country,\u201d Cornyn said. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Texas Democrats, meanwhile, responded to the shooting by pushing for stronger gun laws, but did not provide specifics on what policies would have prevented the man from obtaining weapons. Austin police also did not release details on how the man obtained the two firearms they say he used in the shooting. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Republicans control both chambers of the Texas Legislature and have <a href=\"https:\/\/www.texastribune.org\/2025\/06\/18\/texas-legislature-gun-restrictions\/\" rel=\"nofollow noopener\" target=\"_blank\">routinely loosened gun restrictions<\/a> while Democrats\u2019 bills to curb access gain little traction.  <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Austin-based U.S. Reps. Greg Casar and Lloyd Doggett also denounced gun violence, but did not issue any specific policy proposals. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWe must end America\u2019s gun violence epidemic,\u201d Casar said in <a href=\"https:\/\/x.com\/RepCasar\/status\/2028087121119007156\" rel=\"nofollow\">a post<\/a> on X. \u201cAmericans should be able to have fun at a bar without it turning into an unspeakable nightmare like this one \u2014 and I will redouble my efforts in Congress to prevent the next tragedy like this.\u201d  <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Doggett <a href=\"https:\/\/x.com\/RepLloydDoggett\/status\/2028158264895029339\" rel=\"nofollow\">said<\/a>: \u201cGun violence is preventable. This devastating loss of life was preventable.
