But it would \u201cmake it crystal clear under the state constitution that if you\u2019re not a U.S. citizen you\u2019re not allowed to vote in Texas,\u201d said Gov. <a href=\"https:\/\/directory.texastribune.org\/greg-abbott\/\" rel=\"nofollow noopener\" target=\"_blank\">Greg Abbott<\/a> in <a href=\"https:\/\/x.com\/GregAbbott_TX\/status\/1927105731548819759?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1927105731548819759%7Ctwgr%5E93fdfcc5943bac8c8f816467a7fe58a9f1a50043%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.fox7austin.com%2Fnews%2Ftexas-voting-non-citizens-sjr-37\" rel=\"nofollow\">a social media post<\/a>.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">An effort to require all Texas to show proof of citizenship to register to vote <a href=\"https:\/\/www.votebeat.org\/texas\/2025\/05\/28\/proof-of-citizenship-bill-sb16-hb5337-fizzles-legislature-bryan-hughes-carrie-isaac\/\" rel=\"nofollow noopener\" target=\"_blank\">failed to pass in the legislature this year<\/a>.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Constitutional amendments are the only state measures voters in Texas will see on their ballot this year. They will appear at the top of the ballot and above any local races or measures. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Early voting will run until Oct. 31, and Election Day is Nov. 4. The deadline for counties to receive applications to vote by mail is Oct. 24. Mail ballots must be received by 7 p.m. on election day to be counted. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Here\u2019s what you need to know about the citizenship proposal: <\/p>\n<p>What does the proposed constitutional amendment look like??<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">You\u2019ll see it as Proposition 16 on your ballot. It was introduced as <a href=\"https:\/\/capitol.texas.gov\/tlodocs\/89R\/billtext\/html\/SJ00037S.htm\" rel=\"nofollow noopener\" target=\"_blank\">Senate Joint Resolution 37<\/a> and written by Sen. <a href=\"https:\/\/directory.texastribune.org\/brian-birdwell\/\" rel=\"nofollow noopener\" target=\"_blank\">Brian Birdwell<\/a>, a Republican from North Texas. The Legislature approved its addition to the ballot during the regular session.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">It says, \u201cthe constitutional amendment clarifying that a voter must be a United States citizen,\u201d and voters can select yes or no.<\/p>\n<p>What would it do?<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">It would amend Article 6 of the Texas Constitution, which lists groups that aren\u2019t allowed to vote in Texas. Article 6 currently prohibits voting by people under 18 years old; anyone who has been deemed incompetent by a court; and anyone who has been convicted of a felony. The proposed amendment would add to that list \u201cpersons who are not citizens of the United States.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">However, being a U.S. citizen is already a requirement to vote in federal elections under federal law, and state law says that only U.S. citizens and Texas residents are eligible to vote. That\u2019s why Texans are asked to attest whether they are U.S. citizens when filling out a voter registration card. Anyone who attests on the form that they are not citizens would not be allowed to register. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Noncitizens who vote face state and federal criminal charges and could be at risk of deportation.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Even if it\u2019s approved by voters, the measure would not require voters to show documentary proof \u2013 such as a birth certificate or a U.S. passport \u2014 to register to vote.<\/p>\n<p>What are the arguments for and against the amendment?<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Birdwell said during a public hearing on the proposal earlier this year, that the language in the state constitution would affirm citizenship as a requirement for voting and complement federal law. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Some voting rights activists opposing the amendment said at the time that it would be redundant, since the citizenship requirement is already in place. Others worried the language may mislead voters into believing noncitizens are voting en masse. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">There\u2019s been little campaigning over the amendment on either side. <\/p>\n<p>Have other states considered similar measures?<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Yes. South Dakota, Idaho, Iowa, Kentucky, Missouri, North Carolina, South Carolina, and Oklahoma recently passed similar constitutional amendments, according to the <a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/legislative-approaches-to-ensuring-only-citizens-vote\" rel=\"nofollow noopener\" target=\"_blank\">National Conference of State Legislatures<\/a>.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">And last fall, voters in <a href=\"https:\/\/www.votebeat.org\/wisconsin\/2024\/11\/06\/citizenship-constitutional-amendment-bans-local-noncitizen-voting\/\" rel=\"nofollow noopener\" target=\"_blank\">Wisconsin overwhelmingly approved a GOP-backed measure<\/a> to  change constitutional language that says \u201cevery\u201d U.S. citizen 18 or older has a right to vote. The new wording says \u201conly\u201d a U.S. citizen 18 or older can vote in national, state, and local elections, effectively closing the door to any local ordinances that would allow noncitizens to vote.
