Greg Abbott a day later threatened to \u201ctake over\u201d the municipality. But outside of placing the blame for the water crisis on city officials, what would Abbott\u2019s proposed state takeover of a city actually entail?\u00a0<\/p>\n<p>The gulfside city in southern Texas is weathering a 5-year drought. Despite the state aid and more earmarked from the city, a report from a former water district manager described the city\u2019s soon-to-be depleted reservoirs as a \u201ccontrolled depression\u201d that would see mass unemployment and an \u201cindustrial total shutdown,\u201d according to <a href=\"https:\/\/insideclimatenews.org\/news\/08032026\/after-a-decade-of-missteps-a-texas-city-careens-toward-a-water-shortage-catastrophe\/\" rel=\"nofollow noopener\" target=\"_blank\">Inside Climate News<\/a>.<\/p>\n<p>\t\t<img loading=\"lazy\" decoding=\"async\" class=\"wp-block-san-app-download__qr\" src=\"https:\/\/www.newsbeep.com\/us-tx\/wp-content\/uploads\/2025\/10\/app-download-block-qr-code.png\" alt=\"QR code for SAN app download\" width=\"80\" height=\"80\"\/><\/p>\n<p class=\"wp-block-san-app-download__title\">\n\t\t\tDownload the SAN app today to stay up-to-date with Unbiased. He told the <a href=\"https:\/\/www.houstonchronicle.com\/politics\/texas\/article\/greg-abbott-corpus-christi-water-crisis-22070712.php\" rel=\"nofollow noopener\" target=\"_blank\">Houston Chronicle<\/a> at an event on Tuesday that his office \u201ccan only give them a little time more before the state of Texas has to take over and micromanage that city and run that city,\u201d to ensure Corpus residents didn\u2019t lose water.<\/p>\n<p>Can he do that? Plainly put, yes. Cities aren\u2019t given any sovereign powers under the Constitution. The abilities they do have, from incorporation to taxing to employing police, are all passed down from their respective states.<\/p>\n<p>\u201cAs sovereign, the state has the right to step in temporarily or for longer periods, if a compelling interest requires the same,\u201d said Ron Sandack, attorney at Gaido and Fintzen.\u00a0<\/p>\n<p>Sandack was the mayor of Downers Grove in suburban Chicago and an Illinois lawmaker who had <a href=\"https:\/\/www.illinoispolicy.org\/make-bankruptcy-an-option-for-illinois-municipalities\/\" rel=\"nofollow noopener\" target=\"_blank\">pushed<\/a> to allow financially downtrodden cities like Harvey, another Chicago suburb, to declare bankruptcy.\u00a0<\/p>\n<p>States, including Texas, most typically intervene in that manner when cities are in deep financial trouble. If it can, the municipality will file Chapter 9 <a href=\"https:\/\/san.com\/cc\/rite-aid-closes-all-stores-nationwide-after-second-bankruptcy\/\" rel=\"nofollow noopener\" target=\"_blank\">bankruptcy<\/a> and restructure debt. Detroit, for instance, <a href=\"https:\/\/apnews.com\/article\/kevyn-orr-detroit-bankruptcy-be5b3c78b4c851f1ce28429e0d88db11\" rel=\"nofollow noopener\" target=\"_blank\">filed<\/a> in 2013 and came out of its financial receivership in December 2014.\u00a0<\/p>\n<p>A quick history lesson<\/p>\n<p>The precedent of state supremacy over local mayors dates back to the 1868 Iowa Supreme Court ruling commonly referred to as the <a href=\"https:\/\/www.law.cornell.edu\/wex\/dillon%27s_rule\" rel=\"nofollow noopener\" target=\"_blank\">Dillon Rule<\/a>. The ruling said that any local law or ordinance has to be done so under the umbrella of the state\u2019s legislative blessing. That ruling was affirmed by the U.S. Supreme Court in 1907.<\/p>\n<p>The other side of the Dillon Rule coin is home rule, which gives cities certain powers so long as they don\u2019t clash with state law. States enact laws dictating what cities can enjoy home rule status. Abbott has <a href=\"https:\/\/www.governing.com\/archive\/gov-texas-abbott-preemption.html\" rel=\"nofollow noopener\" target=\"_blank\">toyed<\/a> with the idea of stripping home rule status from cities in Texas before. In 2023, he signed legislation that limited cities\u2019 home rule capacity.
