Instead, arrests typically happen after a court process in which a person is ordered to appear for a hearing and does not show up.<\/p>\n<p>\u201cYou go to jail if there is a court hearing and you do not show up to court, or there is a court order, and you  fail to appear to court, and at that point you are in contempt of court and a warrant for your arrest will be issued,\u201d Labinoti said. <\/p>\n<p>She said that in those situations, \u201cThere was a court hearings you were asked to appear you didn&#8217;t show up. And so then there is a request for a warrant and then you&#8217;re going to be served with a warrant and you&#8217;re going to be arrested.\u201d<\/p>\n<p>Labinoti encouraged people who are struggling to pay to go to court rather than ignore the process.<\/p>\n<p>\u201cIf you are trying to pay child support or you cannot pay child support, then go ahead to the judge, appear to the court ask for a payment plan explain your situation,\u201d she said. \u201cThe courts can be understanding but ignoring a court order not appearing court. It&#8217;s a violation and is a contempt of court.\u201d<\/p>\n<p>She said enforcement actions generally begin with the parent owed support or through an agency.<\/p>\n<p><p>Legal Jargon: Missing child support isn\u2019t automatic jail, skipping court can bring warrant<\/p>\n<\/p>\n<p>\u201cIt generally has to come from the mother,\u201d Labinoti said, adding that \u201cthe division  can do that\u201d and \u201cthe attorney general can do that,\u201d either through an agency or an attorney.
