center of the dispute is Double R Municipal Utility District<\/a>, or MUD, which is responsible for approving water, sewer, and drainage services. A judge this week issued an injunction against the MUD, halting its activity tied to the project.<\/p>\nAttorney General Ken Paxton has publicly criticized the effort, saying, \u201cWe will continue to expose and stop anyone who attempts to exploit our governmental entities or Texas law to advance unlawful or dangerous agendas.\u201d<\/p>\n
The developer\u2019s legal team argues the state\u2019s actions are premature and misplaced.<\/p>\n
“If the attorney came in and sued the roofer on a house that hadn’t even poured the foundation yet, and then said, ‘We stopped them from putting on the roof.’ Well, sure you have, but we haven’t even laid the foundation yet,” said Hudson.<\/p>\n
The Attorney General\u2019s office alleges the MUD board \u201corchestrated an unlawful takeover\u201d and helped the project \u201cevade state oversight.\u201d<\/p>\n
Attorneys emphasize the injunction applies to the MUD\u2014not the developer. A bench trial in the case is scheduled for November.<\/p>\n
Defense attorney Dan Cogdell, who also represents the developer, suggested political motivations may be at play.<\/p>\n
“I get it. He’s in a battle with Cornyn. I understand that, but ‘Ken, do better.’ They are gonna walk right into a lawsuit if they keep this up. That’s about all I will say about that,” said Cogdell.<\/p>\n
Despite the legal fight, the developer says work is continuing and maintains its vision of an inclusive community offering equal housing opportunities\u2014though that message has drawn mixed reactions. Opponents of the development say the plans for a “Muslim-centric” neighborhood are unconstitutional.<\/p>\n
“The state doesn’t really know what’s going on; they’re just swinging for the fences, trying to get injunctions for the Attorney General. Community Capital Partners is still operating. Still ongoing.
