{"id":237742,"date":"2026-04-06T21:50:10","date_gmt":"2026-04-06T21:50:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/237742\/"},"modified":"2026-04-06T21:50:10","modified_gmt":"2026-04-06T21:50:10","slug":"arrest-affidavits-detail-san-marcos-traffic-stop-leading-to-mans-arrest-ice-detainment","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/237742\/","title":{"rendered":"Arrest affidavits detail San Marcos traffic stop leading to man&#8217;s arrest, ICE detainment"},"content":{"rendered":"<p>SAN MARCOS, Texas \u2014 Arrest affidavits reveal new details about the <a href=\"https:\/\/cbsaustin.com\/news\/local\/san-marcos-protestors-call-for-mans-release-from-ice-custody-after-false-report\" target=\"_blank\" rel=\"nofollow noopener\">March 14 traffic stop that led to the arrest<\/a> and subsequent ICE detention of a 44-year-old man in San Marcos.<\/p>\n<p>According to the affidavits, an officer responded at approximately 3:55 a.m. to 1800 Post Rd., where a caller reported her 15-year-old daughter was attempting to leave the apartment and get into a red truck.<\/p>\n<p>On the way to the scene, the officer spotted a red truck and confirmed the license plate matched the caller&#8217;s report. He initiated a traffic stop near the intersection of Aquarena Springs Drive and Charles Austin Drive.<\/p>\n<p>The driver, identified  in the affidavit as Esteban Victor Reyes, 17, refused repeated commands to exit the vehicle. <\/p>\n<p>His father, Gerardo Gonzalez Reyes, 44, who was seated in the passenger seat, grabbed Esteban&#8217;s right arm and physically prevented officers from removing him from the truck, the affidavit states. Gerardo repeatedly told officers they would not be taking Esteban out of the vehicle.<\/p>\n<p>&#8220;I approached the driver&#8217;s side door and again ordered Esteban to exit the vehicle,&#8221; the officer wrote in the affidavit. &#8220;He continued to refuse lawful commands. I then reached into the vehicle and physically removed Esteban, consistent with the authority established in Pennsylvania v. Mimms, which permits officers to order a driver out of a lawfully stopped vehicle.&#8221;<\/p>\n<p>Both Esteban and his father were arrested on charges of interference with public duties and transported to the Hays County Law Enforcement Center.<\/p>\n<p>&#8220;Based on the totality of the circumstances, I believe Esteban, with criminal negligence, impeded my lawful duties as a peace officer by refusing repeated lawful commands to exit the vehicle during a traffic stop. Gerardo further impeded officers by physically preventing the removal of Esteban from the vehicle,&#8221; the officer said in the affidavit.<\/p>\n<p><a href=\"https:\/\/cbsaustin.com\/news\/local\/san-marcos-protestors-call-for-mans-release-from-ice-custody-after-false-report\" target=\"_blank\" rel=\"nofollow noopener\">PREVIOUS COVERAGE | San Marcos protesters call for man\u2019s release from ICE custody after false report<\/a><\/p>\n<p>Authorities later determined that the 15-year-old girl had never left her residence.<\/p>\n<p>After the pair were booked into the jail, the arresting officer learned that Gerardo Gonzalez Reyes was subject to an existing immigration detainer issued by U.S. Immigration and Customs Enforcement. SMPD said the officer was not aware of the detainer while on scene. <\/p>\n<p>Gonzalez Reyes remains in federal custody pending removal proceedings, according to the Department of Homeland Security, which cited prior DWI convictions in 2004 and 2005.<\/p>\n<p>The San Marcos Police Department said it is reviewing the incident.<\/p>\n<p>The case has drawn <a href=\"https:\/\/cbsaustin.com\/news\/local\/san-marcos-protestors-call-for-mans-release-from-ice-custody-after-false-report\" target=\"_blank\" rel=\"nofollow noopener\">protests and scrutiny<\/a> of local law enforcement&#8217;s cooperation with federal immigration authorities. (Photo:{ }Mano Amiga)<\/p>\n<p>The judge noted that Gonzalez Reyes has been a San Antonio resident for several decades, is the primary financial provider for his family, and that his wife is disabled.
