Detectives who interviewed the 34-year-old man found he was not being truthful with his story, and confessed to knowing where the baby was born and who the mother was, police said.\u00a0<\/p>\n

According to an arrest affidavit, an off-duty\u00a0SAPD officer was at a downtown Whataburger restaurant when the 34-year-old man approached him and said he needed help taking the newborn to a hospital.<\/p>\n
The man told the officer that the baby needed \u201cimmediate medical attention\u201d due to neglect from his mother,\u00a0Guerra, according to the affidavit.<\/p>\n
The baby was taken to the hospital in critical condition.<\/p>\n
A detective met up with\u00a0Guerra that same day while she received medical care after giving birth.\u00a0<\/p>\n

She told him that she learned that she was pregnant two months earlier, but she chose not to pursue prenatal medical care. She said she \u201cunexpectedly gave birth\u201d to the baby boy in a toilet at a friend\u2019s apartment, according to the affidavit.\u00a0<\/p>\n
After giving birth,\u00a0Guerra did not call 911 or seek medical care for the newborn, police said.<\/p>\n
Hospital staff told police that the baby was in \u201ccritical, life-threatening condition\u201d and \u201cwould require intensive life-saving medical interventions and procedures for the foreseeable future due to his condition.\u201d<\/p>\n
The baby also had\u00a0methamphetamine in his system, police said.<\/p>\n

Following her release from the hospital, Guerra stopped communicating with police, and a warrant was issued for her arrest, according to the affidavit.<\/p>\n
