See our <a href=\"https:\/\/www.texastribune.org\/about\/ethics\/#ai-policy\" rel=\"nofollow noopener\" target=\"_blank\">AI policy<\/a>, and give us <a href=\"https:\/\/airtable.com\/appFeleeKVUN0Iytx\/pagPG40gbkU0EfjIr\/form\" rel=\"nofollow noopener\" target=\"_blank\">feedback<\/a>.<\/p>\n<p>Texas Railroad Commissioner Wayne Christian is peddling a new crypto token tied to the value of a barrel of West Texas Intermediate crude oil, raising concerns about potential conflicts of interest given his position as an elected official to the state agency that oversees the oil and gas industry in Texas \u2014\u00a0and whose regulatory decisions could impact the value of the token.<\/p>\n<p>Christian, a Republican and one of three members of the Railroad Commission, is listed as a member of the board of directors and chair of the advisory board of Energy Substantiation, the company launching the West Texas Intermediate Coin, or $WTIC, according to materials obtained by The Texas Tribune that the company shared with prospective investors as recently as October.<\/p>\n<p>Christian pitched prospective investors on $WTIC ahead of the coin\u2019s public launch later this year, according to an email from Christian that also was obtained by the Tribune.<\/p>\n<p>\u201cWe are now inviting a limited group of early participants to learn more and consider getting involved at the founding stage,\u201d Christian, who also works as a financial advisor, wrote in the email. \u201cAfter more than 40 years as a financial advisor, I\u2019ve learned that the biggest opportunities are often those recognized early. I believe this one is worth serious consideration.\u201d<\/p>\n<p>Government watchdogs said Christian\u2019s involvement in the company \u2014 especially if he trades in the coin or maintains a financial stake in Energy Substantiation \u2014 gives rise to potential conflicts of interest between his duties as a regulator and his personal business and financial interests.<\/p>\n<p>\u201cRegardless of how the commissioners\u2019 financial interests might influence their decision-making, the potential for a conflict of interests remains,\u201d said Virginia Palacios, executive director of Commission Shift, a nonpartisan organization focused on reforming the Railroad Commission. \u201cTexans deserve elected officials free of potential biases, especially when financial interests are obvious.\u201d<\/p>\n<p>In a statement, Christian defended his involvement in the company, calling it \u201cseparate\u201d from his work at the Railroad Commission and carried out in his personal time and without the use of state resources.<\/p>\n<p>\u201cThe Commission does not regulate cryptocurrency or oil markets, so there is no overlap with my regulatory responsibilities,\u201d Christian said. \u201cAny suggestion otherwise stems solely from the fact that the concept is related to energy.\u201d<\/p>\n<p>Christian declined to answer a question from the Tribune about how he would ensure that his business interests remain separate from his government responsibilities. He also declined to answer questions about whether he owns or plans to trade $WTIC tokens, if he has a financial stake in Energy Substantiation and whether he\u2019s paid to advise the company. His personal financial disclosure statement, which may answer some of those questions, is due to the Texas Ethics Commission on April 30.  <\/p>\n<p>An Energy Substantiation spokesperson said the company invited Christian\u2019s involvement \u201cbecause of his extensive knowledge of the energy sector,\u201d adding that his role was \u201cadvisory in nature.\u201d The spokesperson declined to share whether Energy Substantiation pays Christian in any way, calling compensation arrangements with advisors \u201cprivate company matters.\u201d<\/p>\n<p>\u201cAs with any company operating in an emerging space, we have assembled advisors and board members with deep expertise in energy markets, public policy and commodity finance,\u201d the spokesperson said. \u201cWe take regulatory compliance seriously and structure all of our relationships, including those with advisors and board members, to comply with applicable law.\u201d<\/p>\n<p>The Railroad Commission oversees oil and gas drilling, gas utilities, pipeline safety and coal and uranium surface mining in Texas. The agency\u2019s <a href=\"https:\/\/www.rrc.texas.gov\/about-us\/\" rel=\"nofollow noopener\" target=\"_blank\">stated mission<\/a> is to \u201cserve Texas by our stewardship of natural resources and the environment, our concern for personal and community safety and our support of enhanced development and economic vitality for the benefit of Texans.\u201d<\/p>\n<p>The agency has for years been the target of <a href=\"https:\/\/www.texastribune.org\/2013\/03\/21\/railroad-commission-campaign-finance-battle-looms\/\" rel=\"nofollow noopener\" target=\"_blank\">calls for reform<\/a>, from changing the name of the body \u2014 it no longer regulates railroads \u2014\u00a0to <a href=\"https:\/\/www.houstonchronicle.com\/business\/article\/Oil-and-gas-money-pours-in-for-favored-Railroad-10465128.php\" rel=\"nofollow noopener\" target=\"_blank\">tightening rules<\/a> around <a href=\"https:\/\/commissionshift.org\/news\/captive-agency\/\" rel=\"nofollow noopener\" target=\"_blank\">campaign fundraising<\/a>. <\/p>\n<p>Commissioners <a href=\"https:\/\/www.opensecrets.org\/news\/2024\/08\/texas-oil-regulator-sets-new-9-2m-fundraising-record-with-energy-industry-support\/#:~:text=The%20majority%20of%20the%20donations,totaled%20$250%2C000%20during%20the%20cycle.\" rel=\"nofollow noopener\" target=\"_blank\">routinely accept<\/a> campaign contributions from companies, executives and groups in the industries they regulate and that have cases before the agency. Though commissioners are allowed to maintain personal financial interests in companies they regulate, commissioners must recuse themselves in cases in which they have a \u201cpersonal or private interest.\u201d Those rules do not apply to political donors.<\/p>\n<p>\u201cIt does point to, will the regulator make the right decision for the people of Texas, or will they just make the right decisions for their pocketbook?\u201d Palacios said. \u201cThere\u2019s a lot of decisions that the railroad commissioners make that may constrict revenues for oil and gas companies, but the important thing is that they do their job to protect groundwater supplies, to protect air quality and to protect the future of the people of Texas.\u201d<\/p>\n<p>Tokenizing oil<\/p>\n<p>$WTIC is a new crypto token whose value is tied, one-to-one, to the value of a barrel of West Texas Intermediate crude oil, one of three main global benchmarks for oil pricing. While investors typically trade on oil price changes, $WTIC allows investors to take direct ownership of oil itself, with each token serving as a digital representation of an actual barrel of oil in storage and traded on the blockchain, according to <a href=\"https:\/\/www.energysubstantiation.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Energy Substantiation\u2019s website<\/a> and <a href=\"https:\/\/docs.ensub.io\/\" rel=\"nofollow noopener\" target=\"_blank\">online documentation<\/a>. The token has not publicly launched yet, according to the company spokesperson.<\/p>\n<p>Christian, in his email to prospective investors, touted the venture as \u201can opportunity that brings together two of the most powerful forces shaping the global economy today: energy and blockchain finance.\u201d<\/p>\n<p>He wrote that as a member of the <a href=\"https:\/\/oklahoma.gov\/iogcc\/about-us.html\" rel=\"nofollow noopener\" target=\"_blank\">Interstate Oil and Gas Compact Commission<\/a> \u2014 a multistate government agency to which he was <a href=\"https:\/\/www.rrc.texas.gov\/news\/041117a-christian-appointed-to-iogcc\/\" rel=\"nofollow noopener\" target=\"_blank\">appointed by Gov. Greg Abbott<\/a> \u2014 he participated in discussions about \u201cthe growing threat to the U.S. dollar\u2019s role as the world\u2019s petro-currency\u201d as \u201ckey players like Saudi Arabia have begun accepting alternative currencies from nations like China, Russia and Iran.\u201d<\/p>\n<p>\u201cTexas has an opportunity to lead by unlocking a new dimension of America\u2019s energy inventory through next-generation financial technology,\u201d he wrote, arguing that the United States needed to \u201creinforce its leadership in energy markets tied to dollar-based systems.\u201d<\/p>\n<p>For investors, he wrote, an oil-backed token offered their portfolios direct exposure to the \u201cvalue of a resource that has powered the global economy for more than a century.\u201d For oil and gas producers, Christian wrote, the venture could \u201cexpand access to global capital.\u201d<\/p>\n<p>In pitch materials, Energy Substantiation said Texas \u201chas led the energy revolution,\u201d arguing that the \u201cglobal petrocurrency should be from Texas.\u201d<\/p>\n<p>\u201cTexas business is good business for the US; if not the US, who will step in?\u201d the presentation reads.<\/p>\n<p>Unanswered questions<\/p>\n<p>Christian declined to answer a question about whether he earns a commission or other form of compensation from Energy Substantiation for investors he brings into the fold.<\/p>\n<p>Ethics experts noted that if Christian has a financial stake in Energy Substantiation or personally trades in $WTIC, he would stand to earn more if oil prices were high.<\/p>\n<p>Though oil prices are driven by a range of factors outside the Railroad Commission\u2019s jurisdiction, such as geopolitics and financial markets, the agency has the <a href=\"https:\/\/www.texastribune.org\/2020\/03\/19\/texas-oil-production-reduction-considered-railroad-commission\/\" rel=\"nofollow noopener\" target=\"_blank\">power to curtail oil and gas production<\/a> in Texas \u2014 giving commissioners the ability to shape supply and, thus, prices. <\/p>\n<p>The Railroad Commission \u201chas the power to regulate oil and gas production\u201d in Texas, said Andrew Wheat, an editor at the Austin Free Press who previously served as research director of Texans for Public Justice, a nonpartisan watchdog group. \u201cBy exercising that power \u2014 or not \u2014 it wields great influence over oil prices. Are prices not the intersection of supply and demand?\u201d<\/p>\n<p>Commissioners, including Christian, have long <a href=\"https:\/\/www.texastribune.org\/2025\/09\/03\/texas-methane-oil-emissions-climate\/\" rel=\"nofollow noopener\" target=\"_blank\">supported near-unfettered oil production<\/a>, largely viewing robust environmental regulations and tighter restrictions on practices like flaring <a href=\"https:\/\/www.rrc.texas.gov\/news\/031725-wc-cra-methane-tax\/\" rel=\"nofollow noopener\" target=\"_blank\">as unwelcome limits<\/a> on the industry and the market \u2014\u00a0meaning any moves to constrain oil production and supply would mark a significant departure from their typical postures. <\/p>\n<p>\u201cIf it ever came down to it, I just don\u2019t see Christian trying to limit supply to increase costs,\u201d Wheat said. \u201cBut that would be a conflict if, in fact, he had a substantial monetary interest in this product.\u201d<\/p>\n<p>Andy Cates, a Texas ethics attorney, said any push by Christian to restrict drilling permits or otherwise constrain oil supply \u201ccould have follow along effects\u201d on $WTIC and help prop up the token\u2019s value.<\/p>\n<p>\u201cThat, I would think, would be some sort of market manipulation, some sort of potentially, call it essentially insider trading,\u201d Cates said.<\/p>\n<p>Christian declined to say whether he would recuse himself from regulatory decisions by the Railroad Commission that could impact the token\u2019s value and Energy Substantiation\u2019s revenue. Recusals by commissioners from cases related to companies in which they have financial interests <a href=\"https:\/\/insideclimatenews.org\/news\/24112025\/texas-railroad-commissioner-jim-wright-recusal\/\" rel=\"nofollow noopener\" target=\"_blank\">have been rare<\/a>.<\/p>\n<p>Government watchdogs also raised concerns that Christian\u2019s official title was included in Energy Substantiation\u2019s materials for prospective investors, which could lend credibility to the venture and suggest state backing for the product. Christian was the keynote speaker at Energy Substantiation\u2019s launch in Houston in November, <a href=\"https:\/\/www.linkedin.com\/posts\/energy-substantiation-company_energy-substantiation-is-officially-launching-activity-7393369996980174848-Sz_V?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAACks1O0BZJ-tT78GISCxxbqN11viAIK7g2I\" rel=\"nofollow noopener\" target=\"_blank\">according to a LinkedIn post<\/a>.<\/p>\n<p>\u201cIt does seem like something that an elected official shouldn\u2019t be getting involved with,\u201d Palacios said. \u201cIt gives the impression of favoritism for a specific financial product.\u201d<\/p>\n<p>Christian was listed as a board member and advisor on Energy Substantiation\u2019s website as recently as last week. After the Tribune reached out to Christian for an interview, the <a href=\"https:\/\/www.energysubstantiation.com\/\" rel=\"nofollow noopener\" target=\"_blank\">company\u2019s website<\/a> was overhauled, removing mention of its advisors, including Christian.<\/p>\n<p>A presentation deck the company used to pitch investors described Christian as a \u201cTexan politician heavily involved in energy, oil and gas policymaking,\u201d a \u201cmember and former chair of the Railroad Commission of Texas since 2017,\u201d and \u201cVice Chair, Interstate Oil &amp; Gas Commission.\u201d<\/p>\n<p>\u201cThe inclusion of any advisor\u2019s professional background in company materials reflects their individual qualifications and expertise,\u201d Energy Substantiation\u2019s spokesperson said. \u201cIt does not represent or imply endorsement by any government body, agency or office.\u201d<\/p>\n<p>The materials also described state Sen. <a href=\"https:\/\/directory.texastribune.org\/tan-parker\/\" rel=\"nofollow noopener\" target=\"_blank\">Tan Parker<\/a>, R-Flower Mound and a member of the Senate Natural Resources Committee, as a member of Energy Substantiation\u2019s advisory board. Parker\u2019s Capitol office did not respond to a request for comment. Frank Thorwald, chair of Arizona\u2019s oil and gas regulator, also was named as the vice chair of the board of directors.<\/p>\n","protected":false},"excerpt":{"rendered":"Audio recording is automated for accessibility.
