{"id":252683,"date":"2026-04-16T14:53:24","date_gmt":"2026-04-16T14:53:24","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/252683\/"},"modified":"2026-04-16T14:53:24","modified_gmt":"2026-04-16T14:53:24","slug":"dallas-avoids-state-scrutiny-by-staying-away-from-ice-policies","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/252683\/","title":{"rendered":"Dallas Avoids State Scrutiny by Staying Away From ICE Policies"},"content":{"rendered":"<p>\t\t\t\t<img width=\"1024\" height=\"683\" src=\"https:\/\/www.newsbeep.com\/us-tx\/wp-content\/uploads\/2025\/10\/ice-agent-getty.webp.jpeg\" class=\"article-thumbnail-image wp-post-image\" alt=\"an ICE agent\" decoding=\"async\" fetchpriority=\"high\"  \/><br \/>\n\t\t\t\t\t\tThe Trump administration has authorized Immigration and Customs Enforcement agents to make arrests at schools, churches and hospitals.\t\t\t\t\t\t\t\t\t\t\t\t\t<\/p>\n<p>David Dee Delgado\/Getty Images<\/p>\n<p>Last November, Dallas city leaders found themselves in the hot seat as tension surrounding local law enforcement\u2019s cooperation and coordination with federal immigration enforcement efforts came to a head.\u00a0<\/p>\n<p>After months of community organizers and advocates taking to the city council lectern to ask for transparency, police Chief Daniel Comeaux let it slip that he\u2019d <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dallasobserver.com\/news\/dallas-city-council-formally-rejects-25m-ice-partnership-40614358\/\">rejected a $25 million contract offered by ICE<\/a> that would have reimbursed the police department for the arrests of undocumented Dallasites. The admission caused Mayor Eric Johnson to call for a joint council meeting, arguing that such a fiscal decision should have been made by \u201celected policymakers after receiving public input.\u201d Johnson\u2019s reaction inspired its own wave of outrage.\u00a0<\/p>\n<p>After a particularly tense council meeting, in which nearly 70 public speakers voiced their disappointment that the subject was on the agenda in the first place, a majority of council members agreed that Comeaux had made the right call. (At the meeting, representatives from ICE largely disagreed with Comeaux\u2019s characterization of the partnership offer, but the horseshoe didn\u2019t buy what the feds were selling.)\u00a0<\/p>\n<p>Since that meeting, <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dallasobserver.com\/news\/dallas-council-members-reject-mayors-call-for-ice-partnership-40608569\/\">ICE has largely stayed off the city council\u2019s public radar,<\/a> even as the agency has come under intense national scrutiny and local advocates have pushed the council to adopt policies that would ban a partnership between the agencies.\u00a0<\/p>\n<p>This week has shown that for Dallas officials, that was probably a good thing.\u00a0<\/p>\n<p>Clashing Over Immigration<\/p>\n<p>In the last week, Austin and Houston have found themselves in the crosshairs of Texas\u2019 top Republicans over locally passed ordinances that aim to limit their police departments\u2019 involvement in immigration enforcement efforts.\u00a0<\/p>\n<p>Gov. Greg Abbott is threatening to withhold $110 million in public safety funds from Houston after its city council passed an ordinance on April 8, overruling the local police department\u2019s requirement that officers wait 30 minutes for federal agents to arrive at a scene if they encounter a person with an administrative immigration warrant during their duties. The council also requested that the department provide a quarterly report on its participation in ICE efforts.\u00a0<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.nytimes.com\/2026\/04\/13\/us\/abbott-threatens-houston-police-funding-ice.html\">According to the New York Times, <\/a>Abbott\u2019s threat, if carried out, would imperil Houston\u2019s police and fire departments, which rely on that funding. It could also cripple preparations for the FIFA World Cup less than two months before the tournament begins, creating a scenario that Houston Mayor John Whitmire described as a \u201ccrisis.\u201d\u00a0<\/p>\n<p>\u201cI repeatedly warned the ordinance sponsors\u201d of the \u201clegal and financial risks associated with this approach,\u201d Whitmire said, although he did eventually vote in favor of the measure.\u00a0<\/p>\n<p>The state has given Houston until Monday to pledge not to enforce the new ordinance and to signal an intention to repeal it, the Times reports. Attorney General Ken Paxton has also initiated an investigation into whether <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dallasobserver.com\/news\/dallas-city-council-committee-unanimously-condemns-sb4-immigration-law-19418808\/\">Houston\u2019s ordinance violates Senate Bill 4, <\/a>which bans cities from adopting policies that \u201cprohibit or materially limit the enforcement of immigration laws.\u201d\u00a0<\/p>\n<p>Austin, too, has found itself on the other side of a Paxton investigation for similar reasons.\u00a0<\/p>\n<p>On March 4, the Austin Police Department <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/drive.google.com\/file\/d\/1B_2a_ZdzuYmCtog2DrAkuT5jqoixQxTl\/view\">published its new policy<\/a> on handling interactions with ICE through a city memorandum. Like Houston\u2019s ordinance, the policy prohibits APD officers from arresting a person solely because they have a non-criminal warrant from ICE. City officials claimed the policy change was necessary to ensure officers aren\u2019t bogged down in administrative warrants that prevent them from responding to actual issues.\u00a0<\/p>\n<p>On April 10, Paxton notified Austin leadership that the city was under investigation. The probes set up a potential fight between Texas\u2019 liberal cities and its conservative leadership over whether municipalities have any rights when it comes to responding to immigration enforcement efforts.\u00a0<\/p>\n<p>Worth the Fight?<\/p>\n<p>As far as Dallas goes, the same strategy that has kept it off the radars of top Republicans has been frustrating for community advocates.\u00a0<\/p>\n<p>As recently as February 10, public speakers <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dallasobserver.com\/news\/dallas-attorneys-shut-police-chief-down-at-police-oversight-board-22480574\/\">flooded the Community Police Oversight Board<\/a> and urged Dallas officials to address what the speakers see as a \u201cpolicy gap\u201d that erodes \u201ctransparency\u201d and \u201caccountability\u201d each time the Dallas Police Department assists with an ICE operation.\u00a0<\/p>\n<p>In January, Comeaux rejected the oversight board\u2019s request to publish data on how often DPD interacts with ICE. While Comeaux has said that DPD officers will not conduct immigration investigations, ICE can request that the local police force be present during arrests and raids to help with tasks like enforcing a perimeter.\u00a0At times when Dallas officials have attempted to take a stronger stance \u2014 like last March, when interim police Chief Michael Igo said that the department would not assist with the detainment of undocumented individuals \u2014 it has drawn swift attention from state leaders.<\/p>\n<p>Following Igo\u2019s comments<a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/files\/press\/files\/2025\/Letter%20to%20City%20of%20Dallas%20on%20Sanctuary%20Policies.pdf\">, Paxton opened an investigation into Dallas\u2019<\/a> public safety policies related to immigration. The Observer followed up with the attorney general\u2019s to see what the outcome of that investigation was or if it is still ongoing, but did not hear back.<\/p>\n<p>Still, some local advocates have specifically asked that Dallas pass a policy that would ban ICE agents from wearing masks, allow DPD officers to verify ICE agents\u2019 identities, and require the department to publicly report interactions with the federal agency.
