{"id":252863,"date":"2026-04-16T16:57:09","date_gmt":"2026-04-16T16:57:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/252863\/"},"modified":"2026-04-16T16:57:09","modified_gmt":"2026-04-16T16:57:09","slug":"big-bend-residents-and-national-environmental-group-sue-trump-administration-over-border-wall-plan","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/252863\/","title":{"rendered":"Big Bend residents and national environmental group sue Trump administration over border wall plan"},"content":{"rendered":"<p>A West Texas river guide and church preservation group, along with a national advocacy group, are suing the Trump administration for bypassing federal environmental laws to speed up border wall plans in the state&#8217;s Big Bend region, arguing the move is unconstitutional and would lead to the destruction of &#8220;iconic sections&#8221; of the Rio Grande corridor.<\/p>\n<p>\nBilly Miller, a Terlingua resident and Big Bend area river guide, and the nonprofit <a href=\"https:\/\/www.ruidosachurch.org\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">Friends of the Ruidosa Church<\/a> filed the lawsuit in federal court Thursday alongside the Center for Biological Diversity.<\/p>\n<p>\n&#8220;No one comes to Big Bend to see steel walls and razor wire,&#8221; Miller said in a statement. &#8220;If they build this, they&#8217;re not just destroying a landscape, they&#8217;re wiping out our way of life.&#8221;<\/p>\n<p>\nThe <a href=\"https:\/\/www.documentcloud.org\/documents\/28051570-friends-of-the-ruidosa-church-v-secretary-markwayne-mullin-april-2026\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">lawsuit<\/a> targets regulatory waivers <a href=\"https:\/\/www.marfapublicradio.org\/news\/2026-02-13\/trump-administration-waiving-environmental-regulations-for-border-walls-in-big-bend-area\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">issued in February<\/a> by former Homeland Security Secretary Kristi Noem.<\/p>\n<p>\nThe <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/02\/17\/2026-02994\/determination-pursuant-to-section-102-of-the-illegal-immigration-reform-and-immigrant-responsibility\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">waivers<\/a> allow U.S. Customs and Border Protection to bypass a wide range of ecological and wildlife protection laws as the agency pursues a <a href=\"https:\/\/www.documentcloud.org\/documents\/27823919-border-barrier-system-hudspeth-jeff-davis-and-presidio-counties-request-for-input-2\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">175-mile stretch of planned border wall<\/a> in the region from Hudspeth County through much of Presidio County.<\/p>\n<p>\nWhile the waivers cover a portion of Big Bend Ranch State Park, CBP has <a href=\"https:\/\/www.marfapublicradio.org\/news\/2026-02-13\/trump-administration-waiving-environmental-regulations-for-border-walls-in-big-bend-area\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">indicated<\/a> in <a href=\"https:\/\/www.marfapublicradio.org\/news\/2026-03-06\/trump-administration-removes-big-bend-area-projects-from-smart-wall-plan\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">recent weeks<\/a> it is not currently pursuing physical walls there or in nearby Big Bend National Park. The nonprofit Friends of the Ruidosa Church has worked in recent years to preserve and restore the church.<\/p>\n<p>The Center for Biological Diversity described the case as a novel legal approach to fighting border wall projects.<\/p>\n<p>\nThe group is arguing in part that the administration&#8217;s plan for a wall across the entire U.S.-Mexico border should be considered within the legal framework of the &#8220;major questions doctrine,&#8221; in which courts have found that federal regulatory actions with significant nationwide economic and political impacts should be &#8220;supported by clear congressional authorization,&#8221; as a 2022 <a href=\"https:\/\/www.congress.gov\/crs-product\/IF12077\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">explanation from the Congressional Research Service<\/a> put it.<\/p>\n<p>\nThe U.S. Supreme Court notably cited the major questions doctrine in its February ruling against President Trump&#8217;s sweeping tariffs, <a href=\"https:\/\/www.nytimes.com\/2025\/02\/20\/us\/politics\/supreme-court-trump-tariffs.html\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">as the New York Times reported.<\/a><\/p>\n<p>\n&#8220;Here, too, we think that this administration&#8217;s plan to build the &#8216;great wall&#8217; \u2013 which would be a cross-continental, ocean-to-ocean barrier \u2013 that is a major question,&#8221; Emma Yip, an attorney with the environmental group, said in an interview.<\/p>\n<p>\nYip said the Big Bend area regulatory waivers should be ruled unconstitutional because they advance a &#8220;broader, highly consequential project without explicit approval from Congress.&#8221;<\/p>\n<p>\nThe Department of Homeland Security and CBP did not immediately respond to a request for comment on the lawsuit.<\/p>\n<p>\nThe border wall plan has sparked <a href=\"https:\/\/www.nytimes.com\/2026\/03\/30\/us\/a-border-wall-plan-unites-republicans-and-democrats-in-texas-this-is-insane.html\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">widespread,<\/a> <a href=\"https:\/\/www.kut.org\/politics\/2026-04-04\/austin-tx-big-bend-national-park-protest-border-wall\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">bipartisan opposition<\/a> in the Big Bend region and across Texas.<\/p>\n<p>\nMultiple local governments have in recent weeks approved resolutions arguing the wall would harm their tourism-dependent communities.
