{"id":253179,"date":"2026-04-16T21:02:08","date_gmt":"2026-04-16T21:02:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/253179\/"},"modified":"2026-04-16T21:02:08","modified_gmt":"2026-04-16T21:02:08","slug":"city-thwarts-private-detention-centers-but-cant-block-ice-facility","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/253179\/","title":{"rendered":"City thwarts private detention centers, but can&#8217;t block ICE facility"},"content":{"rendered":"<p><img alt=\"U.S. Immigration and Customs Enforcement in January purchased Oakmont 410, an industrial building constructed by\u00a0Oakmont Industrial Group on San Antonio\u2019s East Side.\" loading=\"eager\" fetchpriority=\"high\"   style=\"aspect-ratio:3 \/ 2\" class=\"x100 y100 opc bgpc ofcv bgscv block bg-gray200 mnh0px fill\"\/><\/p>\n<p>U.S. Immigration and Customs Enforcement in January purchased Oakmont 410, an industrial building constructed by\u00a0Oakmont Industrial Group on San Antonio\u2019s East Side.<\/p>\n<p>Monte Bach\/San Antonio Express-News<\/p>\n<p>The City Council can\u2019t do much to stop an immigration detention center <a href=\"https:\/\/www.expressnews.com\/news\/article\/ice-confirms-buying-san-antonio-site-detention-21334133.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">that\u2019s slated to open on the East Side<\/a>, but a majority of members are trying to thwart private-sector companies from building a similar facility inside city limits.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" alt=\"\" class=\"x1px y1px vh abs\" aria-hidden=\"true\" width=\"1\" height=\"1\"\/><\/p>\n<p>In a 9-2 vote on Thursday, they changed the city\u2019s zoning code to bar detention centers from opening within 1,000 feet of homes, schools, places of worship and public parks without City Council approval, among other new regulations.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>That won\u2019t keep U.S. Immigration and Customs Enforcement from converting an empty warehouse it bought at 542 S.E. Loop 410 to a detention facility, a plan that sparked a backlash from local officials and residents. Council members\u2019 hands are tied because the city has no zoning and permit authority over property owned or leased by the federal government.<\/p>\n<p>Instead, they\u2019re taking aim at what they can control: private facilities.<\/p>\n<p>Operators would have to seek a special zoning designation to open a detention center, unless they can prove they are exempt from the rules\u00a0\u2014 and only federal agencies are exempt. Now you can.<\/a><\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Most people in ICE custody nationwide are held at private facilities because the federal government has turned to companies for help as its detainee population has swelled. However, there are currently no privately operated immigration facilities in San Antonio.<\/p>\n<p>Council members Marc\u00a0Whyte and Misty Spears opposed the code revisions, calling them a waste of taxpayer money that could put the city in the crosshairs of Texas leaders.<\/p>\n<p>\u201cWhat is being attempted here today is to use our code and change it to make a political statement\u00a0\u2014 a political statement regarding federal immigration enforcement activities\u00a0\u2014 and to use our code for those purposes is simply wrong,\u201d Whyte said.<\/p>\n<p>He said Councilman Jalen McKee-Rodriguez, whose district includes the site of the planned ICE warehouse, led the charge and is \u201cgood at ginning things up like this.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>McKee-Rodriguez shot back, saying\u00a0Whyte was complaining about wasting city staff\u2019s time after he spent several minutes \u201ctrying to get a quote in the paper.\u201d<\/p>\n<p>He said he\u2019s concerned about poor conditions that have been documented at privately run immigration facilities, as well as companies that could work with the federal government to open centers in cities where ICE is increasing its presence\u00a0\u2014 like San Antonio.<\/p>\n<p>\u201cIt would be foolish to think that just because there aren\u2019t any facilities now, that there won\u2019t be in the future,\u201d McKee-Rodriguez said.<\/p>\n<p>ICE, which is part of the Department of Homeland Security, bought the warehouse as it expands its detention operations nationwide. The agency said it plans to turn the 639,595-square-foot building into a detention facility but has not said when it will do so.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>ICE said in a planning document two months ago that it will spend $38.3 billion to buy and renovate 34 detention and processing centers by Nov. 30.<\/p>\n<p>Local officials and residents have cited a litany of concerns about the operation, ranging from potentially poor conditions for detainees to burdening city-owned utilities and emergency services to discouraging investment in an area that\u2019s already struggling.<\/p>\n<p>City Council members have been under pressure by San Antonians opposed to the\u00a0center to keep ICE from opening it.<\/p>\n<p>\u201cFor those on City Council who may hesitate to use your local authority because of a retaliatory state and federal government, we urge you to be bold,\u201d ACLU Texas policy and advocacy strategist Sarah Cruz told council members Thursday. \u201cYou can play a critical role in protecting San Antonio residents and help keep families together.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cWe understand that the city has been placed in a difficult position, that your options are limited and that you may have a lot of competing priorities, but helping protect constitutional rights of your residents should be among the top,\u201d she said.<\/p>\n<p class=\"MM_onlineOnly\" title=\"CCI Online Only\">RELATED: <a href=\"https:\/\/www.expressnews.com\/news\/article\/san-antonio-mayor-ice-detention-east-side-22197347.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">San Antonio mayor urges feds not to open ICE detention facility<\/a><\/p>\n<p>Brooks Development Authority CEO Leo Gomez and James Nortey, CEO of\u00a0San Antonio for Growth on the Eastside, said in letters to City Council that they support the code changes because a detention facility would hurt businesses and residents on the East Side. Councilwoman Phyllis\u00a0Viagran said people won\u2019t want to open a store or restaurant near the detention center, or buy or rent a home in the vicinity.<\/p>\n<p>\u201cTexans don\u2019t want to live next to detention facilities,\u201d she said.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The city\u2019s Zoning Commission, a panel of residents that considers zoning requests, recommended at a recent meeting that council members reject the proposed changes.
