Such loans typically carry high interest rates.\u00a0\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The comptroller, the state\u2019s chief tax collector, ultimately declined to allow a second installment agreement, declaring that the more than $400,000 was due, he said.<\/p>\n<p>The Royal Card House was unable to pay the amount, prompting the comptroller to freeze the business\u2019 bank account at <a href=\"https:\/\/www.ssfcu.org\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Security Service Federal Credit Union<\/a>, according to the court filing.<\/p>\n<p>That spurred the club to file for bankruptcy protection despite operating profitably, Greer said during the hearing. He didn\u2019t respond to emails seeking comment.<\/p>\n<p><a href=\"https:\/\/www.ericterrylaw.com\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Eric Terry<\/a>, a San Antonio lawyer, has been appointed the bankruptcy trustee.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cThis is going to be a tough case because of the comptroller issue,\u201d Terry told the judge.<\/p>\n<p class=\"MM_onlineOnly\" title=\"CCI Online Only\">SA Inc.: <a href=\"https:\/\/www.expressnews.com\/newsletters\/sa-inc\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">An insider\u2019s guide to business in San Antonio<\/a><\/p>\n<p>Kevin Lyons, a spokesman for the comptroller\u2019s office, referred questions about the bankruptcy to the Texas Attorney General\u2019s Office, which didn\u2019t respond to a query. The attorney general\u2019s office represents state agencies.<\/p>\n<p>In an email, Lyons said the <a href=\"https:\/\/www.law.cornell.edu\/regulations\/texas\/34-Tex-Admin-Code-SS-3-298\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Texas tax code imposes sales tax<\/a> on amusement services, including \u201cmembership in a private club or organization that provides entertainment, recreational, sports, dining, or social facilities to its members.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>It wasn\u2019t clear whether the comptroller\u2019s office ever advised the club that it was exempt from collecting taxes.\u00a0<\/p>\n<p>The state tax code gives the comptroller the power to freeze bank accounts to recover delinquent taxes and fees when voluntary payment is not received, Lyons said.<\/p>\n<p>The comptroller\u2019s office did not say how often it has pursued similar tax cases against poker clubs.<\/p>\n<p>In its court filing, the Royal Card House described itself as a \u201cprivate social club where members come together to play card games.\u201d The business operates at 7616 Culebra Road.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The case underscores the murky regulatory environment surrounding poker clubs in Texas, which often operate as private, membership-based businesses rather than traditional gambling establishments\u00a0\u2014 even as state regulators seek to tax them.<\/p>\n<p>While most forms of gambling are illegal in Texas, operators of poker clubs argue they fall within a legal exception for private, social gaming.<\/p>\n<p><a href=\"https:\/\/www.instagram.com\/p\/DXJ5SMXjSSq\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Elias Luna III<\/a>, the Royal Card House\u2019s managing member who owns a 50% interest, signed the bankruptcy papers.<\/p>\n<p>\u201cMr. Luna grew up playing poker in his house with friends,\u201d Greer said. That led him to open up the club, the attorney said.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The club has 24 full-time and part-time employees. It received court approval to pay them wages earned before the bankruptcy petition.<\/p>\n<p>The Royal Card House\u2019s\u00a0three creditors and the amounts they are owed are: the comptroller\u2019s office, $428,000; the U.S. Small Business Administration, $95,000; and merchant cash advance lender Superior Capital, $40,000.
