{"id":265592,"date":"2026-04-25T07:18:54","date_gmt":"2026-04-25T07:18:54","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/265592\/"},"modified":"2026-04-25T07:18:54","modified_gmt":"2026-04-25T07:18:54","slug":"austin-pushes-deadline-to-amend-ice-policy-as-state-threatens-millions","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/265592\/","title":{"rendered":"Austin pushes deadline to amend ICE policy as state threatens millions"},"content":{"rendered":"<p>Austin has won a temporary reprieve in a high-stakes dispute with the state, after the governor\u2019s office extended a deadline to roll back police limits on cooperation with federal immigration enforcement, <a href=\"https:\/\/austincurrent.org\/2026\/04\/16\/texas-austin-abbott-ice-threats\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">or risk losing millions of dollars in public safety funding<\/a>.<\/p>\n<p>City leaders say they have been in ongoing talks with the state since Gov. Greg Abbott warned Austin could lose roughly $2.5 million in public safety grants and be forced to repay the money if the Austin Police Department does not reverse recent changes to its <a href=\"https:\/\/www.kut.org\/austin\/2026-03-05\/austin-tx-police-apd-ice-arrests-rules-trump-administration-immigration-deportation\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">policy limiting interaction with ICE<\/a>. The state originally gave Austin until Thursday to comply.<\/p>\n<p>\u201cThe Governor\u2019s office has extended its initial deadline,\u201d said Jenny LaCoste-Caputo, the city\u2019s deputy chief communications director. \u201cWe hope to reach a resolution in the coming days.\u201d<\/p>\n<p>City officials maintain the recent amendments comply with state law, but some acknowledge the millions in public safety funding at stake may be too significant to risk. Meanwhile, community advocates are urging city leaders not to yield to state pressure, setting up a political and legal standoff over how far Austin should go to defend its policy.<\/p>\n<p>\u201cThe public safety grant dollars are vitally important to our community \u2014 providing funding for things like victim services, timely processing of sexual assault evidence, targeted resources to address violence against women, youth diversion programs that keep kids out of the juvenile justice system, and cybersecurity enhancements that protect against cyber attacks and terror threats,\u201d said Ramon Batista, Assistant City Manager for Public Safety. \u201cThe city must be able to allocate its resources in a way that protects public safety.\u201d<\/p>\n<p>In March, the Austin Police Department revised its ICE policy after a January case involving the detention and alleged deportation of a woman and her child <a href=\"https:\/\/www.kut.org\/crime-justice\/2026-02-06\/austin-tx-ice-immigration-apd-police-protest-deportation\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">sparked fierce community backlash<\/a>. The changes were intended to respond to those concerns by limiting some interactions with ICE while maintaining compliance with state law. SB 4, the 2017 state law at the center of the debate, <a href=\"https:\/\/capitol.texas.gov\/tlodocs\/85R\/analysis\/html\/SB00004I.htm\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">penalizes local and state agencies for refusing to enforce immigration laws<\/a>.<\/p>\n<p>State threatens funding over compliance<\/p>\n<p>In that January case, <a href=\"https:\/\/www.kut.org\/crime-justice\/2026-01-16\/austin-tx-any-lopez-belloza-ice-immigration-enforcement-boston-student-deported\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">Honduran-born \u200b\u200bKaren Guti\u00e9rrez Castellanos called police<\/a> about a domestic disturbance in southwest Austin. She was not charged with a crime, but an ICE administrative warrant appeared in her file. The responding officer contacted the federal agency, leading to her detention. <a href=\"https:\/\/www.austintexas.gov\/police\/general-orders\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">Under the recently amended policy<\/a>, Austin police officers \u201care not authorized to make an arrest or detention based solely on an ICE Administrative Warrant.\u201d<\/p>\n<p>The state, however, disputes that APD\u2019s revised policy complies with state requirements, pointing to a 2025 grant certification it says requires Austin to \u201cparticipate fully\u201d with ICE, including notifying and detaining individuals at the request of the Department of Homeland Security.<\/p>\n<p><a href=\"https:\/\/www.texastribune.org\/2026\/04\/16\/texas-greg-abbott-ice-houston-dallas-austin-ice-immigration\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">State leaders have issued similar warnings<\/a>, including threats to pull funding, to Dallas and Houston.
