The rulings are shaking up the state’s hemp industry with some already removing products from shelves. <\/p>\n
DALLAS \u2014 A lot is going on with Texas hemp today.<\/p>\n
First, a Travis County judge has granted a temporary injunction on the smokable hemp ban the state enacted in March, keeping products on the shelves for even longer.<\/p>\n
The temporary injunction halts rules put in place by the Texas Department of State Health Services (DSHS). These rules included new testing procedures that banned many products, and new licensing fees for retailers and manufacturers. \u00a0<\/p>\n
This was all prompted by a lawsuit filed by several entities, including the Texas Hemp Business Council, over the DSHS rules. In the suit, the hemp businesses and organizations claim the state superseded its authority when it banned smokable hemp and rolled out new licensing fees.\u00a0<\/p>\n
“This ruling is an important affirmation that regulatory agencies must operate within the authority granted by the Texas Legislature,” the Texas Hemp Business Council said in an emailed statement.\u00a0<\/p>\n
There are multiple forms of THC. Outside of the new DSHS rules, Texas law only regulates the level of delta-9 THC in products. Delta-9 THC is the main psychoactive component in cannabis that gets users high. Another popular form of THC has been delta-8.\u00a0<\/p>\n
On the same day that a county judge issued the temporary injunction, the Texas Supreme Court issued a ruling in a separate suit that was filed after DSHS tried banning delta-8 THC in 2021. The ruling said that the state can ban delta-8 THC for now.<\/p>\n
“We are actively evaluating the Supreme Court\u2019s decision and its potential implications for this case,” the Texas Hemp Business Council said.\u00a0<\/p>\n
