{"id":318316,"date":"2026-06-01T23:34:33","date_gmt":"2026-06-01T23:34:33","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/318316\/"},"modified":"2026-06-01T23:34:33","modified_gmt":"2026-06-01T23:34:33","slug":"receiver-in-ferrum-capital-case-asks-judge-to-keep-josh-allen-from-selling-assets-in-effort-to-reclaim-money-for-victims","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/318316\/","title":{"rendered":"Receiver in Ferrum Capital case asks judge to keep Josh Allen from selling assets in effort to reclaim money for victims"},"content":{"rendered":"<p class=\"wp-block-paragraph\">A lawyer in San Antonio asked a judge to stop Lubbock businessman Joshua Allen, Allen Financial Agency and Lubbock-based Landzacha Holdings (owned by Allen) from selling or disposing of \u201cvaluable\u201d rights or assets last week.<\/p>\n<p class=\"wp-block-paragraph\">The judge granted the temporary restraining order with a further court hearing on the matter set for June 12.<\/p>\n<p>Brief background<\/p>\n<p class=\"wp-block-paragraph\">Allen and Michael Cox are currently under federal indictment for securities fraud and other charges. The two co-founded Ferrum Capital in Lubbock \u2013 a company accused of conducting a Ponzi scheme \u2013 taking $68 million from 300 or more victims according to court records.<\/p>\n<p class=\"wp-block-paragraph\">Their San Antonio business affiliate Brooklynn Chandler Willy <a href=\"https:\/\/lubbocklights.com\/ferrum-affiliate-willy-pleads-guilty-to-ten-federal-charges-in-san-antonio-joshua-allen-michael-cox-still-awaiting-trial\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">took a plea deal this year<\/a> and will be sentenced in September. <\/p>\n<p class=\"wp-block-paragraph\">In a separate but related matter, Allen was successfully sued in Lubbock for a failed venture in the Amarillo location of Walk-On\u2019s Bistreaux. LubbockLights.com reported on the <a href=\"https:\/\/lubbocklights.com\/collection-efforts-against-joshua-allen-in-walk-ons-case-successfully-completed\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">recovery effort in that case here<\/a>. A court appointed receiver in Lubbock, Max Tarbox, was granted permission to take control of most of Allen\u2019s business assets to collect $835,000. The Lubbock receivership ended on May 8.<\/p>\n<p class=\"wp-block-paragraph\">Ferrum victims sued in late 2023 in San Antonio. In that lawsuit, Ferrum Capital has been under a different court-ordered receiver, John Patrick Lowe.<\/p>\n<p class=\"wp-block-paragraph\">Ferrum victims filed several lawsuits. In one of them, a judge took control of Ferrum Capital away from co-founders Allen and Michael Cox. A court appointed receiver, John Patrick Lowe, has been trying to track down money to pay back all Ferrum victims \u2013 not just the ones in a San Antonio lawsuit.<\/p>\n<p class=\"wp-block-paragraph\">Lowe\u2019s recent request \u2013 filed by his attorney, Royal Lea \u2013 said, \u201cAllen caused the Ferrum companies damages of at least $11,000,000. He caused Plaintiffs in this case damages of at least $50,000,000.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Lowe hired a forensic accountant and his report, according to the request, \u201cestablishes that Ferrum Capital was a Ponzi scheme and that Allen received millions of dollars in fraudulent transfers from the Ponzi scheme.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cWhen called on to testify about Ferrum Capital, the Ponzi scheme and fraud on investors, and his role in the scheme and fraud, Allen refused to answer questions pleading the Fifth Amendment more than 490 times,\u201d the request said.<\/p>\n<p class=\"wp-block-paragraph\">Why now?<\/p>\n<p class=\"wp-block-paragraph\">Allen\u2019s various business interests had been tied up until recently in a Lubbock lawsuit (see our brief background section).
