The suit, filed Wednesday by the municipal development district of Presidio, Texas, against the Department of Homeland Security and U.S. Customs and Border Protection, claims that the administration plans to replace an existing earthen levee protecting the area with segments of the 30-foot-tall concrete border wall<\/a>.<\/p>\n \u201cIf not properly planned and carried out, construction on the federal flood-control works in Presidio could compromise their integrity and leave the region vulnerable to deadly flash floods capable of destroying infrastructure, homes, farmland, and agriculture,\u201d the suit claims.<\/p>\n The district argues the Trump administration has begun handing out millions of dollars in contracts for wall construction<\/a> in the area, moving forward without getting proper permission from the U.S. Army Corps of Engineers to alter a federal water control project under the Rivers and Harbors Act.<\/p>\n In 2008, the binational International Boundary and Water Commission<\/a> invested millions of dollars into a flood control system around Presidio, after Tropical Depression Lowell caused mass flooding in the area and homes were filled with up to 10 feet of water, prompting the governor to make a disaster declaration. <\/p>\n The Independent has contacted DHS for comment.<\/p>\n \u201cCBP continues to develop and finalize its plan for border barrier construction funded by the One Big Beautiful Bill Act, with a focus on the top operational priorities with historical rates of high illegal entry where illegal aliens regularly attempt to enter the United States,\u201d CBP said in a statement to The Independent. \u201cWhile there are priorities for new border wall and detection technology in USBP’s Big Bend Sector, the combination of barriers, roads, and technology (cameras, infrared illuminators, and other detection technology) in the areas adjacent to the Big Bend National Park and State Park are still in the planning stages, while CBP focuses on other higher priority locations.\u201d<\/p>\n \u201cHere in Presidio, the river has never divided us. It\u2019s the reason our whole community is here, on both sides,\u201d John Kennedy, executive director of the Presidio development district, said<\/a> in a statement to Marfa Public Radio. \u201cThe levee is what lets us live safely alongside it, and we\u2019re asking that it get the flood-safety review the law requires before anyone builds on it.\u201d<\/p>\n The Trump administration has waived a variety of contracting and environmental laws to build the wall in the region, but not the Rivers and Harbors Act, the suit, filed alongside the nonprofit Democracy Forward Foundation, argues.<\/p>\n Border wall construction across the region has remained controversial. <\/p>\n In May, facing bipartisan pushback, the administration said it would not build a physical wall through Big Bend National Park<\/a>, a popular national destination with stunning border terrain and a variety of sensitive ecological habitats. <\/p>\n Further west, the Indigenous Tohono O\u2019odham Nation, located within central Arizona, sued the administration<\/a> this week over the wall, alleging DHS plans to build it through tribal land.<\/p>\n \u201cWe do not believe, and we know that Customs and Border Protection has no legal authority to take any of our reservation land nor use it without permission,\u201d Tohono O\u2019odham Chairman Verlon M.
