For Texans who need a rest during long road trips, here\u2019s where it\u2019s legal to sleep in your car.<\/p>\n

If you are road-tripping across the vast state of Texas, you may get tired and need a moment to rest your eyes.<\/p>\n

Texas has several safety rest areas designed to give drivers a break, equipped with air-conditioned bathrooms, Wi-Fi, parking lots, play areas and security. But can you spend the night at one of these?<\/p>\n

While rest areas are considered public property, there are laws regarding how long a car can stay parked. Here\u2019s what the Texas law says.<\/p>\n

Is sleeping at a rest stop in Texas illegal?<\/p>\n

There are no designated laws against Texans sleeping in their cars. However, there is a time limit to how long a car can stay parked at a rest area.<\/p>\n

According to Texas Transportation code section 545.411<\/a>, a person cannot stay parked at a rest area for longer than 24 hours. It would be illegal if the person pitched up a tent, shelter, booth or other structure.<\/p>\n

General rules of thumb for sleeping in your car<\/a> would be to turn off your engine and take the key out of the ignition. Leaving the car lights or engine on could be a disturbance to those who live in the area.<\/p>\n

Where else can you sleep in your car in Texas?<\/p>\n

Sleeping in your car is legal as long as it fits within a city\u2019s ordinances. Sleeping overnight in a parked car in Fort Worth may violate the city\u2019s parking limits<\/a> or camping ordinances<\/a>.<\/p>\n

To sleep on private property, such as another residence, you must get permission from the property owner otherwise it would be considered trespassing.<\/p>\n

Some Walmart<\/a> stores, hospitals, gas stations and gyms may allow overnight parking. It\u2019s best to ask the store manager or an employee before parking overnight to ensure that the specific location allows it.<\/p>\n
